- HOUSE OF REPRESENTATIVES COMMITTEE ON LOCAL GOVERNMENT AND MUNICIPAL FINANCE REP. JAMES LOWER CHAIR COMMITTEE MEETING MINUTES Wednesday, March 13, 2019 12:00 PM Room 521, House Office Building The House Standing Committee on Local Government and Municipal Finance was called to order by Chairman Lower. The Chair requested attendance be called: Present: Reps. Lower, Marino, Crawford, Calley, Howell, Eisen, Meerman, Paquette, Ellison, Sowerby, Garza, Hope, Kuppa. Absent/Excused: None. The Chair laid HB 4095 before the committee: HB 4095 (Rep. Reilly) A bill to amend 2006 PA 110, entitled “Michigan zoning enabling act,” by amending section 102 (MCL 125.3102), as amended by 2008 PA 12. Karla Ruest, representing the Michigan Department of Health and Human Services and the Administration, testified in support of the bill. The following people submitted a card in opposition to the bill: Diane Scheib-Snider, representing Rose Township as the Supervisor. Chestel Koop, the Chairman of Rose Township Zoning Board. Kallie Roesner, representing the Oxford Neighbors Association. Paul Warfield, representing himself. James Unis, representing himself. Representative Howell offered the following amendment to HB 4095: 1. Amend page 4, line 13, by striking out the balance of the subdivision and inserting: "(i) 6 OR FEWER INDIVIDUALS. (ii) 7 TO 10 INDIVIDUALS, IF THE FACILITY IS LICENSED UNDER 1973 PA 116, MCL 722.111 TO 722.128, IS LOCATED ON A PARCEL OF 20 ACRES OR MORE, AND IS NOT LESS THAN 1 MILE FROM ANY OTHER FACILITY DESCRIBED IN THIS SUBPARAGRAPH.". Representative Howell moved to adopt the amendment to HB 4095. The motion prevailed 8-5-0: FAVORABLE ROLL CALL Yeas: Reps. Lower, Marino, Crawford, Calley, Howell, Eisen, Meerman, Paquette. Nays: Reps. Ellison, Sowerby, Garza, Hope, Kuppa. Pass: None. Rep. Marino moved to refer House Bill No. 4095 to the committee on Ways and Means, with recommendation, as amended, as substitute (H-1). The motion prevailed 8-5-0. FAVORABLE ROLL CALL Yeas: Reps. Lower, Marino, Crawford, Calley, Howell, Eisen, Meerman, Paquette. Nays: Reps. Ellison, Sowerby, Garza, Hope, Kuppa. Pass: None. The Chair laid HB 4121 before the committee: HB 4121 (Rep. Byrd) A bill to amend 1893 PA 206, entitled “The general property tax act, “by amending section 78q (MCL 211.78q), as amended by 2016 PA 518. Representative Bryd, Phil Cavanagh and Eric Sabree, both representing the Wayne County Treasurer, all testified in support of the bill. Questions and discussion followed. The following people submitted a card in support of the bill, but did not wish to speak: Kenneth Cole, representing the city of Detroit. Deena Bosworth, representing the Michigan Association of Counties. Brad Ward, representing the Michigan Realtors Association. Judy Allen, representing the Michigan Townships Association. Bill Anderson, representing the Southeast Michigan Council of Governments. Chris Hackbarth, representing the Michigan Municipal League. Andrea Doerr, representing the Michigan Association of County Treasurers. The Chair laid the presentation from the Michigan Association of Drain Commissioners before the committee Deena Bosworth and Joe Bush, both representing the Michigan Association of Drain Commissioners, gave a presentation on their association. Questions and discussion followed. Representative Marino moved to adopt the meeting minutes from 02/27/2019 12:00 PM. There being no objection, the motion prevailed by unanimous consent.
