Context text: The House agreed to the title as amended. Rep. Posthumus moved that the bill be given immediate effect. The motion prevailed, 2/3 of the members serving voting therefor. Rep. Rogers, having reserved the right to explain her protest against the passage of the bill, made the following statement: “Mr. Speaker and members of the House: I voted no on House Bill 4052 and 4053 because the bills are narrowly written to only regulate the legislature and their staff members and does not include the Governor or Lieutenant Governor. As the Legislature is a co-equal branch of government, I believe we should have similar regulations with regard to non-disclosure agreements. NDAs are often used to protect sensitive and proprietary information (including trade secrets,) and confidential business information. Without the option of NDAs, Michigan could risk losing economic development projects to other states who do allow them and may reduce our competitiveness.” Rep. Posthumus moved that House Bill No. 4053 be placed on its immediate passage. The motion prevailed, a majority of the members serving voting therefor.
