- “(6) Unless the property conveyed or transferred under this act is transferred under section 3(1)(c), the instrument making the conveyance or transfer must contain a restriction prohibiting the property from being used for a solar or wind generation project or energy storage facility, unless 1 of the following applies: (a) The generation project or energy storage facility is not connected to the electric grid. (b) The generation project is included in, or, for an energy storage facility, is connected to a project included in, a distributed generation program under section 173 of the clean and renewable energy and energy waste reduction act, 2008 PA 295, MCL 460.1173.” and renumbering the remaining subsections. 4. Amend page 8, line 1, after “subsection” by striking out “(6)” and inserting “(7)”. The motion was seconded and the amendments were adopted, a majority of the members serving voting therefor.
