- Representative Longjohn moved to adopt the amendments to HB 5619. The motion did not prevail 12-16-0: UNFAVORABLE ROLL CALL Yeas: Reps. Tate, O'Neal, Rogers, Steckloff, Glanville, Edwards, Farhat, Martus, McKinney, Morgan, Snyder and Longjohn. Nays: Reps. Bollin, Maddock, Phil Green, Jenkins-Arno, Kelly, Markkanen, Mueller, Slagh, VanWoerkom, Beson, Borton, Roth, Cavitt, Kuhn, Steele and Robinson. Pass: None. Representative O'Neal offered the following amendments to HB 5619: 1. Amend page 91, following line 28, by inserting: "Sec. 721. It is the intent of the legislature that the department reform the strip search protocol so that it results in fewer and less intrusive strip searches of prisoners to maintain the safety and security of correctional facilities. If the department undertakes any efforts to perform fewer and less intrusive strip searches under this section, it must provide a report by April 1 on the efforts undertaken. Sec. 722. (1) From the funds appropriated in part 1, the department shall develop and implement medication distribution and dosing policies that adhere to the following 8 rights of medication administration cited in the Nursing 2018 Drug Handbook and in other nursing resources and guides: (a) The right person. (b) The right medication. (c) The right time. (d) The right dose. (e) The right route. (f) The right reason or position. (g) The right documentation. (h) The right response or right to refuse. Development and implementation of medication distribution and dosing policies is to ensure safe medication administration and to minimize errors. (2) The department shall develop and implement medication distribution and dosing policies including, but not limited to, all of the following: (a) The use of two patient identifiers. (b) Conducting independent double-checks for high-alert medications. (c) Administering medications within a specific window to maintain therapeutic levels. (d) Recording administration immediately after giving the medication, including the dose, route, site, and patient response. (e) Ensuring medication is appropriate for treating the prisoner’s condition. (f) Monitoring the prisoner for the desired effect and any adverse reactions. (g) Allowing only authorized personnel to manage, store, and dispense medications, with in-house pharmacies serving as the primary control point. (h) Storing medications in locked, secure, and organized areas that follow manufacturer temperature requirements. (i) Using older stock first and conducting regular checks for expired or damaged items. Sec. 723. (1) From the funds appropriated in part 1, the department shall ensure non-discriminatory, equitable access for all prisoners with physical or mental impairments that substantially limit major life activities. This includes impairments that are episodic or in remission. (2) The department shall comply with the Americans with Disabilities Act of 1990 and the Persons with Disabilities Civil Rights Act, 1976 PA 220. (3) The department shall assess accommodation needs of prisoners and provide reasonable accommodations. The department shall remove all communication and structural barriers to ensure equal access to services and prisoner programming. (4) The department shall regularly evaluate policies and physical facilities to identify barriers. The department shall train all staff on ADA requirements for accommodating prisoners with disabilities.". 2. Amend page 83, line 5, after “completed” by inserting “at all facilities, including the facilities listed in subsection 1”.
