FELICIA BRABEC CHAIR COMMITTEE MEETING MINUTES Thursday, June 13, 2024 9:00 AM Room 519, House Office Building The House Health Policy Subcommittee on Behavioral Health was called to order by Chair Brabec. The Chair requested attendance be called: Present: Reps. Brabec, Arbit, Pohutsky, Edwards, MacDonell, Rheingans, Schmaltz, Hoadley, Thompson. Absent: Reps. Herzberg, St. Germaine. Excused: Reps. Herzberg, St. Germaine. Representative Hoadley moved to adopt the meeting minutes from May 23, 2024. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5184 and HB 5185 before the committee: HB 5184 (Rep. Brabec) A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 18503, 18504, 18506, 18506a, 18509, and 18518 (MCL 333.18503, 333.18504, 333.18506, 333.18506a, 333.18509, and 333.18518), sections 18503 and 18509 as amended by and sections 18504, 18506, 18506a, and 18518 as added by 2004 PA 61, and by adding section 18515a. HB 5185 (Rep. Edwards) A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 16177, 16348, 18101, and 18501 (MCL 333.16177, 333.16348, 333.18101, and 333.18501), section 16177 as amended by 2006 PA 481, sections 16348 and 18501 as amended by 2004 PA 61, section 18101 as amended by 2019 PA 96. At 9:11 AM, the Chair laid the committee at ease. At 9:12 AM, Majority Vice Chair Arbit called the committee back to order. Representative Brabec, Representative Edwards, and Duane Breijak, representing the National Association of Social Workers-Michigan, testified in support of the bills. Questions and discussion followed. At 9:46 AM, Majority Vice Chair Arbit laid the committee at ease. At 9:47 AM, the Chair called the committee back to order. The Chair laid HB 5178 before the committee: HB 5178 (Rep. Rheingans) A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 7401, 7403, 7404, 7453, and 7457 (MCL 333.7401, 333.7403, 333.7404, 333.7453, and 333.7457), section 7401 as amended by 2016 PA 548, section 7403 as amended by 2016 PA 307, section 7404 as amended by 2016 PA 308, section 7453 as added by 1988 PA 139, and section 7457 as amended by 2006 PA 458, and by adding section 5137. Representative Arbit moved to adopt substitute (H-1) to HB 5178. The motion prevailed 6-3- 0: FAVORABLE ROLL CALL Yeas: Reps. Brabec, Arbit, Pohutsky, Edwards, MacDonell, Rheingans. Nays: Reps. Schmaltz, Hoadley, Thompson. Pass: None. The following people submitted a card in support of HB 5178, but did not wish to speak: Daniel Charrin, representing the Michigan Association of Substances Addiction Providers. Linda Davis, representing Families Against Narcotics. Steve Alsum, representing the Michigan Overdose Prevention Coalition. Sara Ismail, representing ACCESS. Dr. Abdul El-Sayed, representing the Wayne County Health, Human, and Veteran Service Department. The following person submitted a card in opposition to HB 5178, but did not wish to speak: Matt Saxton, representing the Michigan Sheriffs' Association. Representative Pohutsky moved to refer HB 5178 to the Committee on Health Policy, with recommendation as substitute (H-1). The motion prevailed 6-3-0: FAVORABLE ROLL CALL Yeas: Reps. Brabec, Arbit, Pohutsky, Edwards, MacDonell, Rheingans. Nays: Reps. Schmaltz, Hoadley, Thompson. Pass: None. The committee returned to consideration of HB 5184 and HB 5185. Barb Hiltz, representing the University of Michigan, testified in support of HB 5184 and HB 5185. Dr. Catherine Macomber, representing Saginaw Valley State University, testified in support of HB 5184 and HB 5185. Jen Hirsch testified in support of HB 5184 and HB 5185. Dr. Chandra Carr, the Director of the Office of Practicum Education at Wayne State University School of Social Work, testified in support of HB 5184 and HB 5185. Trische Duckworth testified in support of HB 5184 and HB 5185. Brian Philson testified in opposition to HB 5184 and HB 5185. Questions and discussion followed. Dale Atkinson, representing the Atkinson Law Firm, testified in opposition to HB 5184 and HB 5185. Stacey Hardy-Chandler, representing the Association of Social Work Boards, testified in opposition to HB 5184 and HB 5185. The following people submitted a card in support of HB 5184 and HB 5185, but did not wish to speak: Elizabeth Kutter, representing the Michigan Health and Hospital Association. Daniel Cherrin, representing the Michigan Cars Council and Michigan Behavioral Health and Wellness Collaborative. Alan Bolter, representing the Community Mental Health Association of Michigan. The following person submitted a card in opposition to HB 5184 and HB 5185, but did not wish to speak: Gabe Basso, representing Blue Cross Blue Shield of Michigan. Representative Hoadley moved to excuse Representatives Herzberg and St. Germaine from the meeting. There being no objection the motion prevailed by unanimous consent.
