- HOUSE OF REPRESENTATIVES COMMITTEE ON FAMILIES, CHILDREN, AND SENIORS REP. RODNEY WAKEMAN CHAIR COMMITTEE MEETING MINUTES Tuesday, March 16, 2021 12:00 Noon Room 519, House Office Building The House Committee on Families, Children, and Seniors was called to order by the Chair. The Chair requested attendance be called. The Clerk called the attendance and announced a quorum was present. Present: Reps. Wakeman, Wozniak, Marino, Rendon, Tisdel, Pohutsky, Camilleri, Brenda Carter, Aiyash. Absent: None. Excused: None. Representative Wozniak moved to adopt the meeting minutes from March 10, 2021. There being no objections, the motion prevailed by unanimous consent. The Chair laid HB 4071 and HB 4072 before the committee: HB 4071 (Rep. Kahle) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 136b (MCL 750.136b), as amended by 2020 PA 49. HB 4072 (Rep. Calley) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16g of chapter XVII (MCL 777.16g), as amended by 2020 PA 50. Kimberly S. Buddin, Policy Counsel for the American Civil Liberties Union of Michigan, submitted a card in opposition to HB 4071 and HB 4072, but did not wish to speak. Rebecca J. Mastee, JD, Policy Advocate for Michigan Catholic Conference, submitted a card in support of HB 4071 and HB 4072, but did not wish to speak. Jean Doss, representing the Michigan Coalition to End Domestic and Sexual Violence, submitted a card stating is neutral on HB 4071 and HB 4072, but did not wish to speak. Representative Pohutsky offered the following amendment to HB 4071: 1. Amend page 4, line 7, after "nonverbal" by inserting a period and striking out the balance of the subdivision. Representative Pohutsky moved to adopt the amendment to HB 4071. The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Wakeman, Wozniak, Marino, Rendon, Tisdel, Pohutsky, Camilleri, Brenda Carter, Aiyash. Nays: None. Pass: None. Representative Marino moved to refer House Bill No. 4071 to the Committee on Judiciary as amended, as substitute (H-1). The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Wakeman, Wozniak, Marino, Rendon, Tisdel, Pohutsky, Camilleri, Brenda Carter, Aiyash. Nays: None. Pass: None. Representative Rendon moved to refer House Bill No. 4072 to the Committee on Judiciary. The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Wakeman, Wozniak, Marino, Rendon, Tisdel, Pohutsky, Camilleri, Brenda Carter, Aiyash. Nays: None. Pass: None. The Chair laid HB 4159 and HB 4160 before the committee: HB 4159 (Rep. Kuppa) A bill to amend 1931 PA 328, entitled "The Michigan penal code," (MCL 750.1 to 750.568) by adding section 145h. HB 4160 (Rep. Calley) A bill to amend 1931 PA 328, entitled "The Michigan penal code," (MCL 750.1 to 750.568) by adding section 145i. Representative Padma Kuppa, the bill sponsor for HB 4159, and Representative Julie Calley, the bill sponsor for HB 4160, explained their bills. Dawn Hayes, Resource Room Teacher/Corner Collection Founder at Athens High School, testified in support of HB 4159 and HB 4160. A copy of her PowerPoint is attached. Nicole MacMillan, Assistant Attorney from the City of Troy Attorney's Office, testified in support of HB 4159 and HB 4160. Questions followed. Kristine Schule, Detective for City of Troy's Police Department, testified in support of HB 4159 and HB 4160. Dr. Richard Machesky, PhD, Troy School District Superintendent, testified in support of HB 4159 and HB 4160. Annemarie Kelly, JD, LLM, Assistant Professor in the Department of Health Administration, Christina Marsack-Topolewski, PhD, LMSW, at Eastern Michigan University's College of Health and Human Services and testified in support of HB 4159 and HB 4160. A copy of their PowerPoint is attached. The following individuals submitted a card in opposition to HB 4159 and HB 4160, but did not wish to speak: Kimberly S. Buddin, Policy Counsel for the American Civil Liberties Union of Michigan, and Jean Doss, representing the Michigan Coalition to End Domestic and Sexual Violence. A copy of her written handout is attached. The following individuals submitted a card in support of HB 4159 and HB 4160, but did not wish to speak: Sherri Boyd, representing The Arc Michigan, Rebecca J. Mastee, JD, Policy Advocate for Michigan Catholic Conference, and Dan Jarvis, representing Michigan Family Forum. There being no further business before the committee; Representative Tisdel moved that the committee adjourn.
