The Chair requested attendance be called: Present: Reps. Bellino, Markkanen, Hoitenga, Reilly, Berman, Paquette, Schroeder, Martin, Outman, Manoogian, Sneller, Cherry, Haadsma, Morse, Puri, Scott. Absent: Rep. Roth. Excused: Rep. Roth. Representative Morse moved to adopt the meeting minutes from June 17, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5011 and HB 5012 before the committee: HB 5011 (Rep. Rabhi) A bill to amend 2010 PA 270, entitled "Property assessed clean energy act," by amending the title and sections 3, 5, 7, 11, 13, 15, and 17 (MCL 460.933, 460.935, 460.937, 460.941, 460.943, 460.945, and 460.947), section 3 as amended by 2017 PA 242. HB 5012 (Rep. Brabec) A bill to amend 2010 PA 270, entitled "Property assessed clean energy act," by amending section 9 (MCL 460.939), as amended by 2017 PA 242. Representative Manoogian moved to report out HB 5011 with recommendation. The motion prevailed 13-3-0: FAVORABLE ROLL CALL Yeas: Reps. The Chair laid HB 4801 and HB 4802 before the committee: HB 4801 (Rep. Schroeder) A bill to regulate persons that provide electric vehicle charging services; to require registration of certain persons that provide electric vehicle charging services; and to prescribe the powers and duties of certain state officers and entities. HB 4802 (Rep. Kuppa) A bill to amend 1939 PA 3, entitled "An act to provide for the regulation and control of public and certain private utilities and other services affected with a public interest within this state; to provide for alternative energy suppliers; to provide for licensing; to include municipally owned utilities and other providers of energy under certain provisions of this act; to create a public service commission and to prescribe and define its powers and duties; to abolish the Michigan public utilities commission and to confer the powers and duties vested by law on the public service commission; to provide for the powers and duties of certain state governmental officers and entities; to provide for the continuance, transfer, and completion of certain matters and proceedings; to abolish automatic adjustment clauses; to prohibit certain rate increases without notice and hearing; to qualify residential energy conservation programs permitted under state law for certain federal exemption; to create a fund; to encourage the utilization of resource recovery facilities; to prohibit certain acts and practices of providers of energy; to allow for the securitization of stranded costs; to reduce rates; to provide for appeals; to provide appropriations; to declare the effect and purpose of this act; to prescribe remedies and penalties; and to repeal acts and parts of acts," by amending the title and sections 10g, 10h, and 10q (MCL 460.10g, 460.10h, and 460.10q), the title as amended by 2016 PA 341, section 10g as amended by 2008 PA 286, section 10h as added by 2000 PA 142, and section 10q as added by 2000 PA 141. The following people submitted a card with a neutral position on HB 4801, but did not wish to speak: Tim Ward, representing TESLA. Representative Markkanen moved to withdraw the (H-1) sub to HB 4801 that was properly placed before the committee on June 17, 2021. Without objection the motion prevailed. Representative Outman moved to adopt substitute (H-2) to HB 4801. The motion prevailed 11-3-2: FAVORABLE ROLL CALL Yeas: Reps. Representative Schroeder offered the following amendment to HB 4801 (H-2): 1. Amend page 4, line 12, after "accessible" by striking out the balance of the subdivision and inserting a period. Representative Markkanen moved to adopt the amendment to HB 4801 (H-2). The motion prevailed 16-0-0: FAVORABLE ROLL CALL Yeas: Reps. Bellino, Markkanen, Hoitenga, Reilly, Berman, Paquette, Schroeder, Martin, Outman, Manoogian, Sneller, Cherry, Haadsma, Morse, Puri, Scott. Nays: None. Pass: None. Representative Outman moved to report House Bill No. 4801 as amended, as substitute (H- 3). The motion prevailed 11-2-3: FAVORABLE ROLL CALL Yeas: Reps. Representative Paquette moved to withdraw the (H-1) sub to HB 4802 that was properly placed before the committee on June 17, 2021. Without objection the motion prevailed. Representative Hoitenga moved to adopt substitute (H-2) to HB 4802. The motion prevailed 16-0-0: FAVORABLE ROLL CALL Yeas: Reps. Bellino, Markkanen, Hoitenga, Reilly, Berman, Paquette, Schroeder, Outman, Roth, Manoogian, Sneller, Cherry, Haadsma, Morse, Puri, Scott. Nays: None. Pass: None. Representative Schroeder offered the following amendments to HB 4802 (H-2): 1. Amend page 6, line 21, after "charging" by striking out "station" and inserting "device". 2. Amend page 6, line 22, after "charging" by striking out "station" and inserting "device". 3. Amend page 6, line 23, after "charging" by striking out "station" and inserting "device". Representative Schroeder moved to adopt the amendments to HB 4802 (H-2). The motion prevailed 15-0-1: FAVORABLE ROLL CALL Yeas: Reps. Bellino, Markkanen, Hoitenga, Reilly, Paquette, Schroeder, Martin, Outman, Manoogian, Sneller, Cherry, Haadsma, Morse, Puri, Scott. Nays: None. Pass: Rep. Berman. Representative Martin moved to report House Bill No. 4802 as amended, as substitute (H-3). The motion prevailed 10-3-3: FAVORABLE ROLL CALL Yeas: Reps.
