BEAU MATTHEW LAFAVE CHAIR COMMITTEE MEETING MINUTES Tuesday, October 26, 2021 12:00 PM Room 307, House Office Building The House Committee on Military, Veterans and Homeland Security was called to order by Chair LaFave. At 12:00 PM, the Chair laid the committee at ease. At 12:01 PM, the Chair called the committee back to order. The Chair requested attendance be called: Present: Reps. LaFave, Beeler, Eisen, Bezotte, Martin, Rogers, Anthony, Coleman, Steenland. Absent: None. Excused: None. Representative Rogers moved to adopt the meeting minutes from October 19, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid HR 177 before the committee: HR 177 (Rep. LaFave) A resolution to demand that President Biden and the United States Congress provide no support to the Taliban, either direct or indirect, including but not limited to aid. Representative Bezotte moved to report out HR 177 with recommendation. The motion prevailed 7-2-0: FAVORABLE ROLL CALL Yeas: Reps. LaFave, Beeler, Eisen, Bezotte, Martin, Coleman, Steenland. Nays: Reps. Rogers, Anthony. Pass: None. The Chair laid HB 5364, HB 5365, HB 5366 and HB 5367 before the committee: HB 5364 (Rep. Beeler) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 11b of chapter XVII (MCL 777.11b), as amended by 2016 PA 234. HB 5365 (Rep. Markkanen) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 43510 (MCL 324.43510), as amended by 2013 PA 108. HB 5366 (Rep. LaFave) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending sections 227 and 230 (MCL 750.227 and 750.230), section 227 as amended by 1986 PA 8; and to repeal acts and parts of acts. HB 5367 (Rep. LaFave) A bill to amend 1927 PA 372, entitled "An act to regulate and license the selling, purchasing, possessing, and carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices; to prohibit the buying, selling, or carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices without a license or other authorization; to provide for the forfeiture of firearms and electro-muscular disruption devices under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agencies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropriations; and to repeal all acts and parts of acts inconsistent with this act," by amending sections 5a, 5b, 5c, 5f, 5o, 12, 12a, and 15 (MCL 28.425a, 28.425b, 28.425c, 28.425f, 28.425o, 28.432, 28.432a, and 28.435), sections 5a, 5b, and 5o as amended by 2017 PA 95, sections 5c and 5f as amended by 2015 PA 3, section 12 as amended by 2010 PA 209, section 12a as amended by 2016 PA 301, and section 15 as added by 2000 PA 265. At 12:03 PM, the Chair laid the committee at ease. At 12:04 PM, Representative Eisen called the committee back to order. Chair LaFave, Representative Beeler, and Representative Markkanen introduced the bills. Questions and discussion followed. At 12:19 PM, Representative Eisen laid the committee at ease. At 12:20 PM, the Chair called the committee back to order. Brendan Boudreau, representing the Great Lakes Gun Rights, testified in support of HB 5364, HB 5365, HB 5366 and HB 5367. Questions and discussion followed. Paul Stankewitz, representing the Michigan Catholic Conference, testified in opposition to HB 5364, HB 5365, HB 5366 and HB 5367. The following people submitted a card in support of HB 5364, HB 5365 and HB 5366, but did not wish to speak: Brady Schickinger, representing the Michigan Coalition for Responsible Gun Owners. Tom DeRousie, representing the Michigan Gun Owners. The following person submitted a card in opposition to HB 5364, HB 5365, HB 5366 and HB 5367, but did not wish to speak: Frank Foster, representing the Everytown for Gun Safety. The following people submitted a card in opposition to HB 5367, but did not wish to speak: David Randels, representing the Oakland Schools. Jennifer Smith, representing the Michigan Association of School Boards. Brian Broderick, representing the Michigan Association of Non Public Schools. The Chair laid HB 4913 before the committee: HB 4913 (Rep. Beeler) A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1531 (MCL 380.1531), as amended by 2018 PA 235. Representative Beeler introduced the bill. Questions and discussion followed. There being no further business before the committee, Rep. Beau LaFave adjourned the meeting at 12:52 PM.
