HOUSE OF REPRESENTATIVES COMMITTEE ON JUDICIARY REP. GRAHAM FILLER CHAIR COMMITTEE MEETING MINUTES Tuesday, November 9, 2021 9:00 AM Room 519, House Office Building The House Committee on Judiciary was called to order by Chair Filler. The Chair requested attendance be called: Present: Reps. Filler, Mueller, Steven Johnson, Kahle, Rendon, Berman, Wozniak, Clements, LaGrand, Yancey, Bolden, Hope, Breen. Absent: None. Excused: None. Representative Mueller moved to adopt the meeting minutes from November 2, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4894 before the committee: HB 4894 (Rep. VanWoerkom) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 157w (MCL 750.157w), as amended by 1998 PA 312. Representative VanWoerkom testified in support of HB 4894. Questions and discussion followed. The following people submitted a card in support of HB 4894, but did not wish to speak: Patricia Herndon, representing the Michigan Bankers Association. The Chair laid HB 5117 before the committee: HB 5117 (Rep. Wakeman) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending section 3206 (MCL 700.3206), as amended by 2020 PA 246. Representative Wakeman and Phil Douma, representing the Michigan Funeral Directors Association, testified together in support of HB 5117. Questions and discussion followed. The Chair laid HB 5394 and HB 5395 before the committee: HB 5394 (Rep. Allor) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 13m of chapter XVII (MCL 777.13m), as amended by 2016 PA 549. HB 5395 (Rep. Puri) A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 7401, 7403, and 7404 (MCL 333.7401, 333.7403, and 333.7404), section 7401 as amended by 2016 PA 548, section 7403 as amended by 2016 PA 307, and section 7404 as amended by 2016 PA 308. Representative Puri testified in support of HB 5394 and HB 5395. Questions and discussion followed. The Chair laid HB 4084 before the committee: HB 4084 (Rep. Cynthia Johnson) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 8905a (MCL 324.8905a), as amended by 2014 PA 549. Representative Mueller moved to withdraw the (H-2) substitute to HB 4084. There being no objection, the motion prevailed by unanimous consent. The following people submitted a card in support of HB 4084, but did not wish to speak: Megan Tinsley, representing the Michigan Environmental Council. Hallie Fox, representing the Michigan League of Conservation Voters. Mayor Mike Duggan, representing the City of Detroit. John Cool, representing the Michigan Railroad Association. John Lindley, representing the Michigan Manufactured Housing, RV, and Campground Association. Representative Mueller moved to adopt substitute (H-3) to HB 4084. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, Mueller, Steven Johnson, Kahle, Rendon, Berman, Wozniak, Clements, LaGrand, Yancey, Bolden, Hope, Breen. Nays: None. Pass: None. Representative Mueller moved to report out HB 4084 with recommendation, as substitute (H- 3). The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, Mueller, Steven Johnson, Kahle, Rendon, Berman, Wozniak, Clements, LaGrand, Yancey, Bolden, Hope, Breen. Nays: None. Pass: None.
