GARY HOWELL CHAIR COMMITTEE MEETING MINUTES Thursday, December 2, 2021 8:30 AM Room 307, House Office Building The House Committee on Natural Resources and Outdoor Recreation was called to order by Chair Howell. The Chair requested attendance be called: Present: Reps. Howell, Markkanen, LaFave, Wakeman, Martin, Sowerby, Cambensy, Aiyash. Absent: Rep. Eisen. Excused: Rep. Eisen. Representative Cambensy moved to adopt the meeting minutes from October 28, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 251 before the committee: SB 251 (Sen. McBroom) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 47309, 47311, and 47315 (MCL 324.47309, 324.47311, and 324.47315), as added by 1995 PA 57. Senator McBroom testified in support of SB 251. Questions and discussion followed. The following person submitted a card with a neutral position on SB 251, but did not wish to speak: Craig Brunet, representing the Department of Natural Resources. The following person submitted a card in support of SB 251, but did not wish to speak: Scott Everett, a commercial fisherman. The Chair laid HB 5358, HB 5359 and HB 5360 before the committee: HB 5358 (Rep. Howell) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," (MCL 324.101 to 324.90106) by adding sections 43528c and 43528d. HB 5359 (Rep. Cherry) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," (MCL 324.101 to 324.90106) by adding sections 48714a and 48714b. HB 5360 (Rep. Martin) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 40113a (MCL 324.40113a), as amended by 2016 PA 382. Representative LaFave offered the following amendments to HB 5358: 1. Amend page 1, line 1, after "March 1," by striking out "2021," and inserting "2023,". 2. Amend page 6, line 23, after "guide" by inserting "when a hunting client is present". Representative LaFave moved to adopt the amendments to HB 5358. The motion prevailed 8- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Markkanen, LaFave, Wakeman, Martin, Sowerby, Cambensy, Aiyash. Nays: None. Pass: None. Representative Cambensy offered the following amendments to HB 5358: 1. Amend page 6, following line 25, by inserting: "(vii) An individual who provides assistance when a hunting client is not present. (viii) An individual who is compensated for providing assistance to an individual with a disability or physical limitation. As used in this subparagraph, "individual with a disability or physical limitation" means a disabled person as that term is defined in section 19a of the Michigan vehicle code, 1949 PA 300, MCL 257.19a.". 2. Amend page 7, line 15, by striking out all of enacting section 2 and inserting: "Enacting section 2. This amendatory act does not take effect unless all of the following bills of the 101st Legislature are enacted into law: (a) House Bill No. 5359. (b) House Bill No. 5360.". Representative Cambensy moved to adopt the amendments to HB 5358. The motion prevailed 8-0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Markkanen, LaFave, Wakeman, Martin, Sowerby, Cambensy, Aiyash. Nays: None. Pass: None. Representative LaFave offered the following amendments to HB 5359: 1. Amend page 1, line 1, after "March 1," by striking out "2021," and inserting "2023,". 2. Amend page 3, line 26, after "issued." by striking out the balance of the page through "valid." on line 1 of page 4. 2. Amend page 7, line 8, after "48714b." by striking out "(1)". 3. Amend page 7, line 17, by striking out all of subsection (2). Representative LaFave moved to adopt the amendments to HB 5359. The motion prevailed 8- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Markkanen, LaFave, Wakeman, Martin, Sowerby, Cambensy, Aiyash. Nays: None. Pass: None. The following people submitted a card in support of HB 5358, HB 5359 and HB 5360, but did not wish to speak: Craig Brunet, representing the Department of Natural Resources. Bea Friedlander, representing the Attorneys for Animals. Representative Sowerby moved to excuse Representative Eisen from the meeting. There being no objection the motion prevailed by unanimous consent. There being no further business before the committee, Chair Howell adjourned the meeting at 8:51 AM.
