CALLEY CHAIR COMMITTEE MEETING MINUTES Wednesday, December 8, 2021 12:00 PM Room 521, House Office Building The House Committee on Local Government and Municipal Finance was called to order by Chair Calley. The Chair requested attendance be called: Present: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Ellison, Sowerby, Garza, Kuppa, Cavanagh. Absent: Rep. Berman. Excused: Rep. Berman. Representative Slagh joined the committee remotely. Representative Paquette moved to excuse Representative Berman from the meeting. There being no objection the motion prevailed by unanimous consent. Representative Cavanagh moved to adopt the meeting minutes from November 10, 2021. There being no objection, the motion prevailed by unanimous consent. Representative Bezotte moved to adopt the meeting minutes from December 1, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 129 before the committee: SB 129 (Sen. Schmidt) A bill to amend 1897 PA 230, entitled "An act to provide for the formation of corporations for the purpose of owning, maintaining and improving lands and other property kept for the purposes of summer resorts or for ornament, recreation or amusement, and to repeal all laws or parts of laws in conflict herewith; and to impose certain duties on the department of commerce," by amending the title and sections 3, 9, 10, and 23 (MCL 455.3, 455.9, 455.10, and 455.23), the title and section 3 as amended by 1982 PA 117. Steve Gilbert, representing Senator Victory, and Matt Zimmerman, an attorney at Varnum LLP, testified in support of SB 562. Questions and discussion followed. The Chair laid HB 4534 before the committee: HB 4534 (Rep. Slagh) A bill to amend 1893 PA 206, entitled "The general property tax act," by amending sections 7cc and 53b (MCL 211.7cc and 211.53b), section 7cc as amended by 2020 PA 96 and section 53b as amended by 2020 PA 206. Representative Slagh and Tyler Tacoma, Jamestown Township Assessor, testified in support of HB 4534. Questions and discussion followed. Anthony) A bill to prohibit the recording of deeds or other instruments relating to real property that contain certain restrictive covenants or conditions; to make such restrictions unenforceable; and to provide remedies with respect to those instruments. HB 4417 (Rep. Anthony) A bill to amend 1978 PA 59, entitled "Condominium act," by amending section 90 (MCL 559.190), as amended by 2002 PA 283. Representative Anthony, Stewart Sanders, representing the Michigan Association of Register of Deeds, and Charles Hobbs, representing the Lansing Area ACLU Local Unit, testified in support of HB 4416 and HB 4417. Questions and discussion followed. Laura Durand, representing the Civil Rights Litigation Initiative, testified in support of HB 4416 and HB 4417. The following person submitted a card in support of HB 4416, but did not wish to speak: Clay Powell, representing the Rental Property Owners Association of Michigan. The following person submitted a card in opposition to HB 4416, but did not wish to speak: David Pierson, representing the Real Property Law Section of the State Bar of Michigan.
