PAULINE WENDZEL CHAIR COMMITTEE MEETING MINUTES Tuesday, February 1, 2022 10:00 AM Room 327, House Office Building The House Committee on Commerce and Tourism was called to order by Chair Wendzel. The Chair requested attendance be called: Present: Reps. Wendzel, Roth, Alexander, Farrington, Wakeman, Martin, Cambensy, Cherry, Manoogian, Whitsett, Liberati. Absent: None. Excused: None. Representative Roth moved to adopt the meeting minutes from January 25, 2022. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5305 and HB 5306 before the committee: HB 5305 (Rep. Bellino) A bill to amend 1933 PA 167, entitled "General sales tax act," by amending section 4ee (MCL 205.54ee), as added by 2015 PA 251. HB 5306 (Rep. Hertel) A bill to amend 1937 PA 94, entitled "Use tax act," by amending section 4cc (MCL 205.94cc), as added by 2015 PA 252. Representative Roth moved to adopt substitute (H-5) to HB 5305. The motion prevailed 11-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Wendzel, Roth, Alexander, Farrington, Wakeman, Martin, Cambensy, Cherry, Manoogian, Whitsett, Liberati. Nays: None. Pass: None. Representative Cherry offered the following amendments to HB 5305 (H-5): 1. Amend page 3, line 12, after "2046" by inserting "or, with respect to an enterprise data center subject to a certificate that is located on the property included in a brownfield plan under the brownfield redevelopment financing act, 1996 PA 381, MCL 125.2651 to 125.2670, or on property that was once an industrial site used primarily as a power plant to generate electricity for sale, through December 31, 2061". 2. Amend page 8, line 17, after "2046" by inserting "or, for a facility that is located on the property included in a brownfield plan under the brownfield redevelopment financing act, 1996 PA 381, MCL 125.2651 to 125.2670, or on property that was once an industrial site used primarily as a power plant to generate electricity for sale, through December 31, 2061". Representative Cherry moved to adopt the amendments to HB 5305 (h-5). The motion prevailed 11-0-0: FAVORABLE ROLL CALL Yeas: Reps.
