ROGER HAUCK CHAIR COMMITTEE MEETING MINUTES Tuesday, March 22, 2022 10:30 AM Room 519, House Office Building The House Committee on Regulatory Reform was called to order by Chair Hauck. The Chair requested attendance be called: Present: Reps. Hauck, Hoitenga, Bellino, Hall, Mueller, Wendzel, Clements, Damoose, Outman, Hertel, Yancey, Garza, Witwer, Steenland, Young. Absent: None. Excused: None. Representative Yancey joined the committee remotely. Representative Bellino moved to adopt the meeting minutes from March 15, 2022. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5538 before the committee: HB 5538 (Rep. Cambensy) A bill to amend 1937 PA 306, entitled "An act to promote the safety, welfare, and educational interests of the people of this state by regulating the construction, reconstruction, and remodeling of, and the installation of certain security devices at, certain public or private school buildings or additions to those buildings and by regulating the construction, reconstruction, and remodeling of, and the installation of certain security devices at, buildings leased or acquired for school purposes; to define the class of buildings affected by this act; to prescribe the powers and duties of certain state agencies and officials; to prescribe penalties for the violation of this act; and to repeal acts and parts of acts," by amending sections 1, 1a, and 2 (MCL 388.851, 388.851a, and 388.852), section 1 as amended by 2004 PA 510 and section 2 as amended by 2002 PA 627. Hoitenga) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending sections 3009, 3037, 3101, and 3113 (MCL 500.3009, 500.3037, 500.3101, and 500.3113), section 3009 as amended by 2019 PA 22, section 3037 as amended by 2016 PA 346, and sections 3101 and 3113 as amended by 2019 PA 21, and by adding section 3018. HB 4916 (Rep. O'Neal) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 401 (MCL 257.401), as amended by 2002 PA 652. HB 4917 (Rep. Outman) A bill to provide for peer-to-peer car sharing; to impose obligations on and provide rights to persons that operate peer-to-peer car sharing, shared vehicle owners, and shared vehicle drivers; to impose obligations on and provide rights to insurers that provide automobile insurance for persons that operate peer-to-peer car sharing, shared vehicle owners, and shared vehicle drivers; to provide rights to persons operating airports; to provide for liability for personal injuries and property damage in peer-to-peer car sharing; and to provide remedies. Representative Outman moved to adopt substitute (H-2) to HB 4915. The motion prevailed 14-0-0: FAVORABLE ROLL CALL Yeas: Reps. Tyler Diers, representing the TechNet, testified in opposition to HB 4915, HB 4916 and HB 4917. Representative Hoitenga offered the following amendment to HB 4915 (H-2): 1. Amend page 4, line 10, after "3018." by striking out the balance of the section and inserting: "(1) An authorized insurer that writes automobile insurance in this state may exclude any coverage and the duty to defend or indemnify for any claim afforded under a shared vehicle owner's automobile insurance policy, including, but not limited to, all of the following: (a) Liability coverage for bodily injury and property damage. (b) Personal injury protection coverage. (c) Uninsured and underinsured motorist coverage. (d) Comprehensive physical damage coverage. (e) Collision physical damage coverage. (2) As used in this section, "shared vehicle owner" means that term as defined in section 3 of the peer-to-peer car sharing program act.". Representative Hoitenga moved to adopt the amendment to HB 4915 (H-2). The motion prevailed 14-0-0: FAVORABLE ROLL CALL Yeas: Reps.
