CALLEY CHAIR COMMITTEE MEETING MINUTES Wednesday, March 23, 2022 12:00 PM Room 521, House Office Building The House Committee on Local Government and Municipal Finance was called to order by Chair Calley. The Chair requested attendance be called: Present: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Berman, Paquette, Slagh, Ellison, Sowerby, Garza, Kuppa, Cavanagh. Absent: None. Excused: None. Representative Berman joined the committee remotely. The Chair laid HB 5863 and HB 5864 before the committee: HB 5863 (Rep. Roth) A bill to amend 1897 PA 230, entitled "An act to provide for the formation of corporations for the purpose of owning, maintaining and improving lands and other property kept for the purposes of summer resorts or for ornament, recreation or amusement, and to repeal all laws or parts of laws in conflict herewith; and to impose certain duties on the department of commerce," (MCL 455.1 to 455.24) by adding section 19. HB 5864 (Rep. Roth) A bill to amend 1982 PA 162, entitled "Nonprofit corporation act," by amending section 123 (MCL 450.2123), as amended by 2014 PA 557. Representative Roth testified in support of HB 5863 and HB 5864. Questions and discussion followed. Anne Treadway and Frederick Baker, representing the Neahtawanta Resort Association, testified in support of HB 5863 and HB 5864. The following person submitted a card with a neutral position on HB 5863 and HB 5864, but did not wish to speak: Mack Jones, representing the Michigan Licensing and Regulatory Affairs Department. The Chair laid SB 525 before the committee: SB 525 (Sen. Wojno) A bill to amend 1966 PA 293, entitled "An act to provide for the establishment of charter counties; to provide for the election of charter commissioners; to prescribe their powers and duties; to prohibit certain acts of a county board of commissioners after the approval of the election of a charter commission; to prescribe the mandatory and permissive provisions of a charter; to provide for the exercise by a charter county of certain powers whether or not authorized by its charter; and to prescribe penalties and provide remedies," (MCL 45.501 to 45.521) by adding section 14b. Senator Wojno testified in support of SB 525. Questions and discussion followed. The Chair laid SB 821 before the committee: SB 821 (Sen. Schmidt) A bill to amend 1988 PA 57, entitled "An act to provide for the incorporation by 2 or more municipalities of certain authorities for the purpose of providing emergency services to municipalities; to provide for the powers and duties of authorities and of certain state and local agencies and officers; to provide for certain condemnation proceedings; to provide for fees; to provide for the levy of property taxes for certain purposes; and to prescribe penalties and provide remedies," by amending the title and section 9 (MCL 124.609), the title as amended by 2011 PA 261 and section 9 as amended by 2006 PA 652, and by adding section 9a. Representative Bezotte moved to report out SB 821 with recommendation. The motion prevailed 12-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Ellison, Sowerby, Garza, Kuppa, Cavanagh. Nays: None. Pass: None. The Chair laid HB 4884 and HB 4885 before the committee: HB 4884 (Rep. Marino) A bill to amend 1976 PA 451, entitled "The revised school code," by amending sections 619 and 1107 (MCL 380.619 and 380.1107), as added by 2004 PA 234. HB 4885 (Rep. Yaroch) A bill to amend 1954 PA 116, entitled "Michigan election law," by amending sections 207, 268, 327, 369, and 383 (MCL 168.207, 168.268, 168.327, 168.369, and 168.383), section 327 as amended by 1982 PA 505 and section 383 as amended by 2018 PA 120. Representative Yaroch explained (H-1) for HB 4884 and HB 4885. Representative Bezotte moved to adopt substitute (H-1) to HB 4884. The motion prevailed 12-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Ellison, Sowerby, Garza, Kuppa, Cavanagh. Nays: None. Pass: None. Representative Howell moved to report out HB 4884 with recommendation, as substitute (H- 1). The motion prevailed 8-1-3: FAVORABLE ROLL CALL Yeas: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Garza. Nays: Rep. Sowerby. Pass: Reps. Ellison, Kuppa, Cavanagh. Representative Bellino moved to adopt substitute (H-1) to HB 4885. The motion prevailed 10-1-1: FAVORABLE ROLL CALL Yeas: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Ellison, Garza, Kuppa. Nays: Rep. Sowerby. Pass: Rep. Cavanagh. Representative Paquette moved to report out HB 4885 with recommendation, as substitute (H-1). The motion prevailed 8-1-3: FAVORABLE ROLL CALL Yeas: Reps. Calley, Bezotte, Howell, Alexander, Bellino, Paquette, Slagh, Garza. Nays: Rep. Sowerby. Pass: Reps. Ellison, Kuppa, Cavanagh. Representative Alexander moved to adopt the meeting minutes from March 16, 2022. There being no objection, the motion prevailed by unanimous consent.
