- HOUSE OF REPRESENTATIVES COMMITTEE ON TRANSPORTATION REP. JACK O'MALLEY CHAIR COMMITTEE MEETING MINUTES Tuesday, June 14, 2022 10:30 AM Room 521, House Office Building The House Committee on Transportation was called to order by Chair O'Malley. The Chair requested attendance be called: Present: Reps. O'Malley, Eisen, Howell, Griffin, LaFave, Carra, Roth, Harris, Sneller, Clemente, Shannon, Liberati, Puri. Absent: None. Excused: None. Representatives Clemente, Shannon and Liberati joined the committee remotely. Representative Puri moved to adopt the meeting minutes from May 24, 2022. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 39 and SB 43 before the committee: SB 39 (Sen. Victory) A bill to amend 1909 PA 283, entitled "An act to revise, consolidate, and add to the laws relating to the establishment, opening, discontinuing, vacating, closing, altering, improvement, maintenance, and use of the public highways and private roads; the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; maintaining public access to waterways under certain conditions; setting and protecting shade trees, drainage, and cutting weeds and brush within this state; providing for the election or appointment and defining the powers, duties, and compensation of state, county, township, and district highway officials; and to prescribe penalties and provide remedies," by amending section 21 (MCL 224.21), as amended by 1996 PA 23. SB 43 (Sen. Victory) A bill to amend 1964 PA 170, entitled "An act to make uniform the liability of municipal corporations, political subdivisions, and the state, its agencies and departments, officers, employees, and volunteers thereof, and members of certain boards, councils, and task forces when engaged in the exercise or discharge of a governmental function, for injuries to property and persons; to define and limit this liability; to define and limit the liability of the state when engaged in a proprietary function; to authorize the purchase of liability insurance to protect against loss arising out of this liability; to provide for defending certain claims made against public officers, employees, and volunteers and for paying damages sought or awarded against them; to provide for the legal defense of public officers, employees, and volunteers; to provide for reimbursement of public officers and employees for certain legal expenses; and to repeal acts and parts of acts," by amending section 2 (MCL 691.1402), as amended by 2012 PA 50. Mike Wikowski, representing Senator Victory's office, testified in support of SB 39 and SB 43. Adam Tountas, representing the Michigan County Road Commission Self-Insurance Pool, testified in support of SB 39 and SB 43. The following people submitted a card with a neutral position on SB 39 and SB 43, but did not wish to speak: Troy Hagon, representing the Michigan Department of Transportation. The following people submitted a card in support of SB 39 and SB 43, but did not wish to speak: Ed Noyola, representing the County Road Association of Michigan. Deena Bosworth, representing the Michigan Association of Counties. The Chair laid HB 6216 and HB 6217 before the committee: HB 6216 (Rep. O'Malley) A bill to amend 1978 PA 368, entitled "Public health code," by amending section 5139 (MCL 333.5139), as added by 2012 PA 354. HB 6217 (Rep. O'Malley) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 309 (MCL 257.309), as amended by 2022 PA 45, and by adding section 309a. At 10:35 AM, the Chair laid the committee at ease. At 10:36 AM, Majority Vice Chair Eisen called the committee back to order. Representative O'Malley testified in support of HB 6216 and HB 6217. Questions and discussion followed. Brianna Romines, representing the Epilepsy Foundation of Michigan, testified in support of HB 6216 and HB 6217. Questions and discussion followed. Gregory L. Barkley, M.D., representing the Epilepsy Foundation of Michigan, testified in support of HB 6216 and HB 6217. Questions and discussion followed. Jenita Moore, representing the Michigan Department of State, testified with no position on HB 6217. Questions and discussion followed.
