- HOUSE OF REPRESENTATIVES COMMITTEE ON JUDICIARY REP. GRAHAM FILLER CHAIR COMMITTEE MEETING MINUTES Tuesday, February 26, 2019 9:00 AM Room 519, House Office Building The House Standing Committee on Judiciary was called to order by Chairman Filler. The Chair requested attendance be called: Present: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Bolden. Members absent/excused: Rep. Yancey. Representative LaFave moved to adopt the meeting minutes from February 19, 2019. There being no objection, the motion prevailed by unanimous consent. Representative LaGrand moved to excuse absent members from the meeting. Without objection Rep. Yancey was excused from the meeting. The Chair laid HB 4161 and SB 87 before the committee: HB 4161 (Rep. LaFave) A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961,"by amending section 8160 (MCL 600.8160), as amended by 2012 PA 21. SB 87 (Sen. McBroom) A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961,"by amending section 8160 (MCL 600.8160), as amended by 2012 PA 21. Representative LaFave and Senator McBroom testified together in support of the bills. Questions and discussion followed. The following people submitted a card in support of the bills, but did not wish to speak: Tom Clement, representing the State Court Administrative Office. Meghann Keit, representing the Michigan Association of Counties. Chairman Filler laid before the committee a presentation by the Michigan Domestic and Sexual Violence Prevention and Treatment Board. Angela Povilaitis and Debi Cain, both representing the Michigan Domestic and Sexual Violence Prevention and Treatment Board, gave a presentation to the committee. The Chair laid HB 4001, HB 4002 and SB 2 before the committee: HB 4001 (Rep. Wentworth) A bill to amend 1978 PA 368, entitled "Public health code," by amending section 7521 (MCL 333.7521), as amended by 2015 PA 154, and by adding section 7521a. HB 4002 (Rep. LaGrand) A bill to amend 1978 PA 368, entitled "Public health code," by amending section 7523 (MCL 333.7523), as amended by 2016 PA 418, and by adding section 7523a. SB 2 (Sen. Lucido) A bill to amend 1978 PA 368, entitled "Public health code," by amending section 7523 (MCL 333.7523), as amended by 2016 PA 418, and by adding section 7521a. The following people submitted a card with a neutral position on the bills, but did not wish to speak: The Michigan State Police. Blaine Koops, representing the Michigan Sheriffs Association. Representative LaFave moved to adopt substitute (H-2) to HB 4001. The motion prevailed 12-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Representative LaFave offered the following amendment to HB 4002: 1. Amend page 2, line 8, after "published" by striking out the balance of the line through "or" on line 9. Amend page 2, line 9, after “website” by striking out “or” and inserting “and”. Representative LaFave moved to adopt the amendment to HB 4002. The motion prevailed 9-3-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Berman, Wozniak, LaGrand. Nays: Reps. Guerra, Elder, Bolden. Pass: None. Representative LaGrand offered the following amendment to HB 4002: 1. Amend page 6, line 4, after "knowledge" by striking out "or reasonably should have known". Representative LaGrand moved to adopt the amendment to HB 4002. The motion prevailed 12-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Bolden. Nays: None. Pass: None. At 9:34 AM, the Chair laid the committee at ease. At 9:37 AM, the Chair called the committee back to order. Representative Berman offered the following amendment to HB 4002: 1. Amend page 1, line 8, after “seized” by striking out “or,” and inserting “and,”. Representative Berman moved to adopt the amendment to HB 4002. The motion prevailed 12-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Bolden. Nays: None. Pass: None. Rep. Farrington moved to report House Bill No. 4002 as amended, as substitute (H-3). The motion prevailed, the vote being 12-0-0. FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Bolden. Nays: None. Pass: None. Representative Howell moved to report out Senate Bill No. 2 with the recommendation that the bill pass. The motion prevailed 9-0-3: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, S. Johnson, Rendon, Wozniak, LaGrand, Bolden. Nays: None. Pass: Reps. Berman, Guerra, Elder. Chairman Filler laid before the committee a presentation by the Prosecuting Attorneys Association of Michigan. DJ Hilson and Bill Vaillencourt, both representing the Prosecuting Attorneys Association of Michigan, gave a presentation to the committee.
