HOUSE OF REPRESENTATIVES COMMITTEE ON NATURAL RESOURCES AND OUTDOOR RECREATION REP. GARY HOWELL CHAIR COMMITTEE MEETING MINUTES Tuesday, April 16, 2019 12:00 PM Room 326, House Office Building The House Standing Committee on Natural Resources and Outdoor Recreation was called to order by the Chair. The Chair requested attendance be called: Present: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Absent/Excused: None. Representative Eisen moved to adopt the minutes from the April 9th, 2019 meeting. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4227 before the committee: HB 4227 (Rep. Cambensy) A bill to create a committee on Michigan's mining future; to provide for the powers and duties of certain governmental officers and agencies; and to repeal acts and parts of acts. Representative Sara Cambensy testified in support of HB 4227. Questions and discussion followed. The following people submitted a card in opposition of HB 4227, but did not wish to speak: Sean McBreardy, representing the Clean Water Action. Representative Sowerby moved to adopt substitute (H-2) to HB 4227. The motion prevailed 9-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Nays: None. Pass: None. Representative Sowerby offered the following amendment to HB 4227 (H-2): 1. Amend page 2, line 13, by striking out all of subparagraph (vii) and inserting: “(vii) A member representing a municipality in this state where a ferrous, metallic nonferrous ,or aggregate mining operation is located.”. Representative Sowerby explained the amendment. Representative Sowerby moved to adopt the amendment to HB 4227 (H-2). The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Nays: None. Pass: None. Representative Pohutsky offered the following amendment to HB 4227 (H-2): 1. Amend page 2, line 14, by striking out all of subparagraph (viii) and inserting: (viii) A resident of this state who is a member of a federally recognized Indian tribe that has trust lands in this state.. Representative Pohutsky moved to adopt the amendment to HB 4227 (H-2). The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Nays: None. Pass: None. Representative Wakeman moved to refer House Bill No. 4227 to the committee on Ways and Means, with recommendation as substitute (H-3). The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Nays: None. Pass: None. Wes Windover, representing the Michigan Association of Timbermen, gave a presentation.
