BEAU M LAFAVE CHAIR COMMITTEE MEETING MINUTES Tuesday, May 7, 2019 12:00 p.m. Room 307, House Office Building The House Standing Committee on Military, Veterans and Homeland Security was called to order by the Chair. The Chair requested attendance be called: Present: Reps. LaFave, Mueller, Marino, Afendoulis, Markkanen, Jones, Chirkun, T Carter, Manoogian. Absent/Excused: None. Representative Mueller moved to adopt the meeting minutes from April 30, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4331 before the committee: HB 4331 (Rep. LaFave) A bill to amend 1994 PA 451, entitled “Natural resources and environmental protection act,” by amending section 40111 (MCL 324.40111), as amended by 2018 PA 272. Craig Brunet and Lt. Joe Molnar, representing Michigan Department of Natural Resources, testified in opposition to HB 4331. Questions and discussion followed. The following person submitted a card in support of HB 4331, but did not wish to speak: Jason Gillman Jr., representing Michigan Open Carry. Representative Markkanen moved to refer House Bill No. 4331 to the committee on Judiciary. The motion prevailed 8-1-0: FAVORABLE ROLL CALL Yeas: Reps. LaFave, Mueller, Marino, Afendoulis, Markkanen, Jones, Chirkun, T Carter. Nays: Rep. Manoogian. Pass: None. The Chair laid HB 4434 before the committee: HB 4434 (Rep. Hall) A bill to amend 1931 PA 328, entitled “The Michigan penal code,” by amending section 227 (MCL 750.227), as amended by 1986 PA 8. Representative T Carter offered the following amendments to HB 4434: 1. Amend page 2, line 5, after "(4)" by inserting "OR (6)". 2. Amend page 2, line 10, after "IF" by striking out "BOTH" and inserting "ALL". 3. Amend page 2, following line 16, by inserting: "(C) THE VIOLATION IS THE PERSON'S FIRST VIOLATION THAT OCCURS DURING THE 1-YEAR PERIOD DESCRIBED IN SUBDIVISION (A).". 4. Amend page 2, following line 20, by inserting: "(6) A PERSON WHO VIOLATES SUBSECTION (2) IS GUILTY OF A MISDEMEANOR PUNISHABLE BY IMPRISONMENT FOR NOT MORE THAN 90 DAYS OR A FINE OF $500.00, OR BOTH, IF ALL OF THE FOLLOWING APPLY: (A) THE PERSON'S CONCEALED PISTOL LICENSE ISSUED UNDER SECTION 5B OF 1927 PA 372, MCL 28.425B, EXPIRED NOT MORE THAN 1 YEAR BEFORE THE DATE OF THE VIOLATION. (B) THE PERSON IS ELIGIBLE TO OBTAIN A CONCEALED PISTOL LICENSE UNDER SECTION 5B OF 1927 PA 372, MCL 28.425B. (C) THE VIOLATION IS THE PERSON'S SECOND OR SUBSEQUENT VIOLATION THAT OCCURS DURING THE 1-YEAR PERIOD DESCRIBED IN SUBDIVISION (A).". Representative T Carter moved to adopt the amendments to HB 4434. The motion prevailed 9-0- 0: FAVORABLE ROLL CALL Yeas: Reps. LaFave, Mueller, Marino, Afendoulis, Markkanen, Jones, Chirkun, T Carter, Manoogian. Nays: None. Pass: None. Scott Nichols, representing Moms Demand Action, testified in opposition to HB 4434. Questions and discussion followed. The following person submitted a card in support of HB 4434, but did not wish to speak: Jason Gillman Jr., representing Michigan Open Carry. The following person submitted a card in opposition to HB 4434, but did not wish to speak: Frank Foster, representing Everytown for Gun Safety. Representative Marino moved to refer House Bill No. 4434 as amended, as substitute (H-1). The motion prevailed by a vote of 9-0-0. FAVORABLE ROLL CALL: Yeas: Reps. LaFave, Mueller, Marino, Afendoulis, Markkanen, Jones, Chirkun, T Carter, Manoogian. Nays: None. Pass: None. Amy Trotter, representing Michigan United Conservation Clubs, testified in opposition to HB 4331. There being no further business before the committee, Rep.
