MICHAEL WEBBER CHAIR COMMITTEE MEETING MINUTES Tuesday, May 14, 2019 10:30 AM Room 521, House Office Building The House Standing Committee on Regulatory Reform was called to order by the Chair Webber. The Chair requested attendance be called: Present: Reps. Webber, Berman, Crawford, Farrington, Frederick, Hoitenga, Filler, Hall, Wendzel, Chirkun, Liberati, Cambensy, Jones, Garza, Robinson. Absent/Excused: None. Representative Berman moved to adopt the meeting minutes from May 7, 2019. There being no objection, the motion prevailed by unanimous consent. At 10:37 AM, the Chair laid the committee at ease. At 10:40 AM, the Chair called the committee back to order. The Chair laid HB 4335 before the committee: HB 4335 (Rep. Yaroch) A bill to amend 1980 PA 299, entitled “Occupational code,” by amending sections 1110 and 1205 (MCL 339.1110 and 339.1205), section 1110 as amended by 2014 PA 137 and section 1205 as amended by 1997 PA 97. Representative Robinson spoke to the amendment. Representative Robinson offered the following amendment to HB 4335: 1. Amend page 2, line 10, after “with” by striking out “1 or more” and inserting “not fewer than 2”. Representative Robinson moved to adopt the amendment to HB 4335. The motion did not prevail 6-9-0: UNFAVORABLE ROLL CALL Yeas: Reps. Chirkun, Liberati, Cambensy, Jones, Garza, Robinson. Nays: Reps. Webber, Berman, Crawford, Farrington, Frederick, Hoitenga, Filler, Hall, Wendzel. Pass: None. Representative Robinson spoke to the amendments. Amend page 4, line 23, after the first "SUBSECTION" by striking out "AND SUBSECTION (7)". 4. Amend page 4, line 26, by striking out all of subsection (7) and renumbering the remaining subsection. 5. Amend page 5, line 12, after "licensed." by striking out "EXCEPT AS PROVIDED IN SUBSECTION (7), THE" and inserting "THE". 6. Amend page 9, line 4, after the first "SUBSECTION" by striking out "AND SUBSECTION (7)". 7. Amend page 9, line 7, by striking out all of subsection (7) and renumbering the remaining subsection. Representative Robinson moved to adopt the amendments to HB 4335. The motion did not prevail 6-9-0: UNFAVORABLE ROLL CALL Yeas: Reps. Chirkun, Liberati, Cambensy, Jones, Garza, Robinson. Nays: Reps. Representative Chirkun moved to refer House Bill No. 4335 to the committee on Ways and Means. The motion prevailed 13-1-1: FAVORABLE ROLL CALL Yeas: Reps. The Chair laid HB 4495 before the committee: HB 4495 (Rep. Warren) A bill to amend 1937 PA 306, entitled "An act to promote the safety, welfare, and educational interests of the people of the state of Michigan by regulating the construction, reconstruction, and remodeling of certain public or private school buildings or additions to such buildings, by regulating the construction, reconstruction, and remodeling of buildings leased or acquired for school purposes, and to define the class of buildings affected by this act; to prescribe the powers and duties of certain state agencies and officials; to prescribe penalties for the violation of this act; and to repeal acts and parts of acts," by amending sections 1, 1a, and 2 (MCL 388.851, 388.851a, and 388.852), section 1 as amended by 2004 PA 510 and section 2 as amended by 2002 PA 627. Michael Livendale, representing the Design-Build Institute of America, testified in support of the bill. Questions and discussion followed. Charles Baltmou, Stephens Smith and Dan La Pau, all representing the American Institute of Architects, testified in opposition to the bill. Questions and discussion followed. Ron Brenke, representing the American Council of Engineering Companies, testified in opposition to the bill. Questions and discussion followed. The following people submitted a card in support of HB 4495, but did not wish to speak: Jennifer Smith, representing the Michigan Association of School Boards. The Chair laid SB 0239 before the committee: SB 0239 (Sen. Chang) A bill to amend 1980 PA 299, entitled "Occupational code," by amending section 1803 (MCL 339.1803). Ellen Heinitz, representing Senator Chang testified in support of the bill. Questions and discussion followed.
