MICHAEL WEBBER CHAIR COMMITTEE MEETING MINUTES Tuesday, May 21, 2019 10:30 AM Room 521, House Office Building The House Standing Committee on Regulatory Reform was called to order by the Chair Webber. The Chair requested attendance be called: Present: Reps. Webber, Berman, Crawford, Farrington, Frederick, Hoitenga, Filler, Hall, Wendzel, Chirkun, Liberati, Cambensy, Jones, Garza, Robinson. Absent/Excused: None. Representative Farrington moved to adopt the meeting minutes from May 14, 2019. There being no objection, the motion prevailed by unanimous consent. At 10:37 AM, the Chair laid the committee at ease. At 10:40 AM, the Chair called the committee back to order. The Chair laid HB 4411 before the committee: HB 4411 (Rep. Lilly) A bill to amend 1994 PA 160, entitled “Credit services protection act,” by amending section 3 (MCL 445.1823). Representative Jones offered the following amendment to HB 4411: 1. Amend page 3, line 8, after "(iii)" by striking out "THE" and inserting "THE WRITTEN AGREEMENT STATES THAT THE". Representative Jones spoke to his amendment. Representative Jones moved to adopt the amendment to HB 4411. The motion prevailed 15-0-0: FAVORABLE ROLL CALL Yeas: Reps. Webber, Berman, Crawford, Farrington, Frederick, Hoitenga, Filler, Hall, Wendzel, Chirkun, Liberati, Cambensy, Jones, Garza, Robinson. Nays: None. Pass: None. Representative Chirkun moved to refer House Bill No. 4411 as amended, as substitute (H-1). The motion prevailed 15-0-0: FAVORABLE ROLL CALL Yeas: Reps. The Chair laid SB 0239 before the committee: SB 0239 (Sen. Chang) A bill to amend 1980 PA 299, entitled” Occupational code,” by amending section 1803 (MCL 339.1803). Representative Chirkun moved to refer Senate Bill No. 239 to the committee on Ways and Means. The motion prevailed 15-0-0: FAVORABLE ROLL CALL Yeas: Reps. At 10:45 AM, the Chair laid the committee at ease. At 10:54 AM, the Chair called the committee back to order. The Chair laid HB 4548 before the committee: HB 4548 (Rep. Kahle) A bill to amend 1972 PA 230, entitled "Stille-DeRossett-Hale single state construction code act,"(MCL 125.1501 to 125.1531) by adding section 13h. Representative Kahle, along with Ryan Row, the Superintendent for Madison School District, testified on the bill. Questions and discussion followed. The Chair laid HB 4488, HB 4489 and HB 4490 before the committee: HB 4488 (Rep. Iden) A bill to amend 1974 PA 381, entitled “An act to encourage and contribute to the rehabilitation of former offenders and to assist them in the assumption of the responsibilities of citizenship; to prescribe the use of the term "good moral character" or similar term as a requirement for an occupational or professional license or when used as a requirement to establish or operate an organization or facility regulated by this state; and to provide administrative and judicial procedures to contest licensing board or agency rulings thereon,” by amending the title and sections 1, 2, 3, 4, 5, 6, and 7 (MCL 338.41, 338.42, 338.43, 338.44, 338.45, 338.46, and 338.47), section 2 as amended by 2014 PA 361. HB 4489 (Rep. Bellino) A bill to amend 1961 PA 236, entitled “Revised judicature act of 1961,"by amending section 934 (MCL 600.934), as amended by 2004 PA 558. HB 4490 (Rep. Hoitenga) A bill to amend 2016 PA 407, entitled “Skilled trades regulation act, “by amending section 105 (MCL 339.5105). HB 4491 (Rep. Griffin) Health occupations; other; eligibility requirements for certain licenses and registrations under the public health code; revise. HB 4492 (Rep. Gay-Dagnogo) Occupations; other; eligibility requirements for certain licenses and regulations under the occupational code; revise. HB 4493 (Rep. Warren) Occupations; individual licensing and registration; annual report on issuance or denial of licensure based on lack of good moral character; require Representative Iden, and Representative Gay-Dagnogo testified in support of the bills. Questions and discussion followed. Jarrett Skorup, representing the Mackinac Center, Kimberly Buddin, representing American Civil Liberties Union of Michigan, and Anna Kohn, representing Gary Wozniak and Recovery Park, all testified in support of the bills. Keith Bernett and Jessica McCall, representing the Goodwill Industries of Detroit. Brian Westrin, representing Michigan Realtors, testified in opposition to the bills. The following individuals submitted a card in support of the bill, but did not wish to speak: Andy Johnston, representing the West Michigan Policy Forum, and Grand Rapids Chamber. Joshua Hue, representing Safe and Just Michigan. Peter Ruark, representing the Michigan League for Public Policy. Nate Love, representing the Foundation for Government Accountability. The following individuals submitted a card in opposition to the bill, but did not wish to speak: John Tramontana, representing the Michiana Veterinary Medical Association. Michelle Batora, Michigan Society of Professional Surveyors. Ron Brenke, representing American Council of Engineering Companies. Leanne Panduren, representing the Michigan Society of Professional Engineers There being no further business before the committee, Rep. Michael Webber adjourned the meeting at 11:52 AM.
