JACK O'MALLEY CHAIR COMMITTEE MEETING MINUTES Tuesday, September 10, 2019 10:30 AM Room 327, House Office Building The House Standing Committee on Transportation was called to order by the Chair. The Chair requested attendance be called: Present: Reps. O'Malley, Eisen, Cole, Sheppard, Alexander, Bellino, Howell, Afendoulis, Sneller, Clemente, Haadsma, Shannon. Absent/Excused: Rep. Yancey. Representative Sheppard moved to adopt the meeting minutes from June 18, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4628 before the committee: HB 4628 (Rep. Shannon) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 208 (MCL 257.208), as amended by 2006 PA 565. Representative Shannon gave an overview of his bill and proposed amendment. The following person submitted a card in support of HB 4628, but did not wish to speak: Jenita Moore, representing the Michigan Secretary of State. Representative Shannon offered the following amendment to HB 4628: 1. Amend page 3, line 21, after "Beginning" by striking out "February 16," and inserting "July 16,". Representative Shannon moved to adopt the amendment to HB 4628. The motion prevailed 11-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Wittenberg) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 636 (MCL 257.636), as amended by 2018 PA 279. HB 4396 (Rep. Wittenberg) A bill to amend 1925 PA 368, entitled "An act to prohibit obstructions and encroachments on public highways; to provide for the removal of obstructions and encroachments on public highways; to prescribe the conditions under which telegraph, telephone, power, and other public utility companies, cable television companies, broadband companies, and municipalities may enter upon, construct, and maintain telegraph, telephone, power, cable television, or broadband lines, pipe lines, wires, cables, poles, conduits, sewers, and like structures upon, over, across, or under public roads, bridges, streets, and waters; and to prescribe penalties and provide remedies," by repealing section 19 (MCL 247.189). Representative Wittenberg testified in support of HB 4395 and HB 4396. Ed Noyola, representing Michigan County Road Association, testified in opposition of HB 4396. Representative Wittenberg returned to answer further questions with Mr. Noyola. The following person submitted a card in support of HB 4395 and HB 4396, but did not wish to speak: Sgt. Nicole McGhee, representing the Michigan State Police. Representative Bellino moved to excuse Representative Yancey from the meeting. There being no objection the motion prevailed by unanimous consent. There being no further business before the committee, Rep. Jack O'Malley adjourned the meeting at 11:07 AM.
