- HOUSE OF REPRESENTATIVES COMMITTEE ON MILITARY, VETERANS AND HOMELAND SECURITY REP. BEAU M LAFAVE CHAIR COMMITTEE MEETING MINUTES Tuesday, October 15, 2019 12:00 PM Room 307, House Office Building The House Standing Committee on Military, Veterans and Homeland Security was called to order by Chair LaFave. At 12:00 PM, the Chair laid the committee at ease. At 12:01 PM, the Chair called the committee back to order. The Chair requested attendance be called: Present: Reps. LaFave, Mueller, Marino, Afendoulis, Markkanen, Jones, Chirkun, Tyrone Carter, Manoogian. Absent/Excused: None. Representative Jones moved to adopt the meeting minutes from October 8, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774 before the committee: HB 4770 (Rep. Johnson) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending sections 231 and 237a (MCL 750.231 and 750.237a), as amended by 2017 PA 96; and to repeal acts and parts of acts. HB 4771 (Rep. Reilly) A bill to amend 1927 PA 372, entitled "An act to regulate and license the selling, purchasing, possessing, and carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices; to prohibit the buying, selling, or carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices without a license or other authorization; to provide for the forfeiture of firearms and electro-muscular disruption devices under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agencies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropriations; and to repeal all acts and parts of acts inconsistent with this act," by amending sections 2, 2a, 5b, 5o, 12, and 15 (MCL 28.422, 28.422a, 28.425b, 28.425o, 28.432, and 28.435), section 2 as amended by 2015 PA 200, section 2a as amended by 2016 PA 301, sections 5b and 5o as amended by 2017 PA 95, section 12 as amended by 2010 PA 209, and section 15 as added by 2000 PA 265. HB 4772 (Rep. Hoitenga) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 43510 (MCL 324.43510), as amended by 2013 PA 108. HB 4773 (Rep. Maddock)A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 12 of chapter IX and sections 11b and 16m of chapter XVII (MCL 769.12, 777.11b, and 777.16m), section 12 of chapter IX as amended by 2012 PA 319, section 11b of chapter XVII as amended by 2016 PA 234, and section 16m of chapter XVII as amended by 2018 PA 637. HB 4774 (Rep. Hornberger) A bill to amend 1953 PA 232, entitled "Corrections code of 1953," by amending section 33b (MCL 791.233b), as amended by 2019 PA 16. Representatives Johnson, Hornberger and Hoitenga testified in support of HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. Representative Reilly testified in support of HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. Steve Dolan, representing the Michigan Coalition for Responsible Gun Owners, testified in support of HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. Carmi Finn, representing Moms Demand Action, testified in opposition to HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. Tom Lambert, representing Michigan Open Carry, testified in support of HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. Lee Miracle representing the Southeast Michigan Volunteer Militia, testified in support of HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774. The following people submitted a card in opposition to HB 4770, HB 4771, HB 4772, HB 4773 and HB 4774, but did not wish to speak: Sean Sorenson-Abbott, representing the Michigan Health and Hospital Association.
