HOUSE OF REPRESENTATIVES COMMITTEE ON ELECTIONS AND ETHICS REP. JULIE CALLEY CHAIR COMMITTEE MEETING MINUTES Wednesday, October 16, 2019 10:31 AM Room 327, House Office Building The House Standing Committee on Elections and Ethics was called to order by the Chair. The Chair requested attendance be called: Present: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra, Hope. Absent/Excused: None. Representative Paquette moved to adopt the minutes from the October 2nd, 2019 meeting. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4823 before the committee: HB 4823 (Rep. Bellino) A bill to amend 1893 PA 206, entitled" The general property tax act," by amending section 24f (MCL 211.24f), as amended by 2000 PA 244. Representative Paquette offered the following amendment to HB 4823: 1. Amend page 4, line 12, after "schools"" by inserting "if a list of each school district and other constituent districts to which revenue from the millage will be disbursed is posted by the city or township clerk in 1 or more conspicuous places in each election precinct in which the question appears on the ballot". Representative Paquette spoke to his amendment. Representative Paquette moved to adopt the amendment to HB 4823. The motion prevailed 6-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Paquette, Guerra, Hope. Nays: None. Pass: None. The following people submitted a card in support of HB 4823, but did not wish to speak: Patti Tremblay, representing the MI Association of Intermediate School Administrators. Jeff Cobb, representing the MI Association of School Boards. Representative Paquette moved to refer House Bill No. 4823 as amended, as substitute (H-1). The motion prevailed 6-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Paquette, Guerra, Hope. Nays: None. Pass: None. The Chair laid HB 4937 before the committee: HB 4937 (Rep. Bollin) A bill to amend 1966 PA 261, entitled" An act to provide for the apportionment of county boards of commissioners; to prescribe the size of the board; to provide for appeals; to prescribe the manner of election of the members of the county board of commissioners; to provide for compensation of members; to prescribe penalties and provide remedies; and to repeal acts and parts of acts," by amending sections 10 and 12 (MCL 46.410 and 46.412), section 12 as amended by 2013 PA 84. HB 4937 (H-1) was adopted during the previous meeting on October 2nd, 2019. Representative Hornberger moved to refer House Bill No. 4937 to the committee on Ways and Means, with recommendation as substitute (H-1). The motion prevailed 6-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Paquette, Guerra, Hope. Nays: None. Pass: None. The Chair laid HB 4938 before the committee: HB 4938 (Rep. Lightner) A bill to amend 1966 PA 293, entitled" An act to provide for the establishment of charter counties; to provide for the election of charter commissioners; to prescribe their powers and duties; to prohibit certain acts of a county board of commissioners after the approval of the election of a charter commission; to prescribe the mandatory and permissive provisions of a charter; to provide for the exercise by a charter county of certain powers whether or not authorized by its charter; and to prescribe penalties and provide remedies," by amending section 14 (MCL 45.514), as amended by 2017 PA 210. Representative Sheppard moved to refer House Bill No. 4938 to the committee on Ways and Means. The motion prevailed 6-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Paquette, Guerra, Hope. Nays: None. Pass: None. The following people submitted a card in support of HB 4937 and HB 4938, but did not wish to speak: Elizabeth Hundley, representing Livingston County. Joe Bridgman, representing Livingston County. The Chair laid HB 5031 and HB 5032 before the committee: HB 5031 (Rep. Bollin) A bill to amend 1954 PA 116, entitled" Michigan election law," by amending section 662 (MCL 168.662), as amended by 2004 PA 92. HB 5032 (Rep. Bollin) A bill to amend 1954 PA 116, entitled" Michigan election law," by amending sections 658, 659, and 661 (MCL 168.658, 168.659, and 168.661), sections 658 and 661 as amended by 2012 PA 270 and section 659 as amended by 2014 PA 94, and by adding section 759e. Representative Bollin testified in support of HB 5031 and HB 5032. Chris Swope and Kim Meltzer, representing the Council of Election Officials, testified in support of HB 5031 and HB 5032. The following people submitted a card with a neutral position on HB 5031 and HB 5032, but did not wish to speak: Jenita Moore, representing the Michigan Secretary of State. The following people submitted a card in support of HB 5031 and HB 5032, but did not wish to speak: Joe Bridgman, representing Livingston County. Elizabeth Hundley, representing Livingston County. Merissa Kovach, representing the ACLU of Michigan, testified in opposition of HB 5032.
