- HOUSE OF REPRESENTATIVES COMMITTEE ON ELECTIONS AND ETHICS REP. JULIE CALLEY CHAIR COMMITTEE MEETING MINUTES Wednesday, October 30, 2019 10:30 AM Room 327, House Office Building The House Standing Committee on Elections and Ethics was called to order by Chair Calley. The Chair requested attendance be called: Present: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra, Hope. Absent/Excused: None. Representative Sheppard moved to adopt the minutes from the October 16th, 2019 meeting. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5123 before the committee: HB 5123 (Rep. Bollin) A bill to amend 1954 PA 116, entitled "Michigan election law," by amending section 765a (MCL 168.765a), as added by 2018 PA 123. Representative Bollin testified in support of HB 5123. The following people submitted a card in opposition to HB 5123, but did not wish to speak: Thomas Gilpin, representing the MI Sierra Club. At 10:41 AM, the Chair laid the committee at ease. At 10:42 AM, the Majority Vice Chair Jason Sheppard called the committee back to order. The Chair laid HB 5141 before the committee: HB 5141 (Rep. Calley) A bill to amend 1954 PA 116, entitled" Michigan election law," by amending section 765a (MCL 168.765a), as added by 2018 PA 123, and by adding sections 764d and 764e. Representative Calley testified in support of HB 5141. Justin Roebuck, representing Ottawa County Clerk/ Michigan Association of County Clerks, testified in support of HB 5141. At 10:47 AM, the Majority Vice Chair Jason Sheppard laid the committee at ease. At 10:49 AM, the Chair called the committee back to order. The Chair laid HB 5031 before the committee: HB 5031 (Rep. Bollin) A bill to amend 1954 PA 116, entitled" Michigan election law," by amending section 662 (MCL 168.662), as amended by 2004 PA 92. Representative Sheppard moved to adopt substitute (H-1) to HB 5031. The motion prevailed 7-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra, Hope. Nays: None. Pass: None. Representative Sheppard moved to refer House Bill No. 5031 to the committee on Ways and Means, with recommendation as substitute (H-1). The motion prevailed 6-0-1: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra. Nays: None. Pass: Rep. Hope. The following people submitted a card in support of HB 5031, but did not wish to speak: Nick Occhipinti, representing the MI League of Conservation Voters. Merissa Kovach, representing the ACLU. The following people submitted a card in opposition to HB 5031, but did not wish to speak: Thomas Gilpin, representing the MI Sierra Club. The Chair laid HB 5032 before the committee: HB 5032 (Rep. Bollin) A bill to amend 1954 PA 116, entitled" Michigan election law," by amending sections 658, 659, and 661 (MCL 168.658, 168.659, and 168.661), sections 658 and 661 as amended by 2012 PA 270 and section 659 as amended by 2014 PA 94, and by adding section 759e. Representative Marino moved to adopt substitute (H-1) to HB 5032. The motion prevailed 7-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra, Hope. Nays: None. Pass: None. Representative Sheppard offered the following amendment to HB 5032 (H-1): 1. Amend page 6, line 4, after "elector's" by striking out "signature and". Representative Sheppard moved to adopt the amendment to HB 5032 (H-1). The motion prevailed 7-0-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Marino, Paquette, Guerra, Hope. Nays: None. Pass: None. Representative Hope offered the following amendment to HB 5032 (H-1): 1. Amend page 2, line 22, after "than" by striking out "60" and inserting "120". Representative Hope moved to adopt the amendment to HB 5032 (H-1). The motion did not prevail 2-5-0: UNFAVORABLE ROLL CALL Yeas: Reps. Guerra, Hope. Nays: Reps. Calley, Sheppard, Hornberger, Marino, Paquette. Pass: None. Representative Guerra offered the following amendment to HB 5032 (H-1): 1. Amend page 6, following line 25, by inserting: "Enacting section 1. Section 658 of the Michigan election law, 1954 PA 116, MCL 168.658, as amended by this amendatory act, takes effect January 1, 2021.". Representative Guerra moved to adopt the amendment to HB 5032 (H-1). The motion did not prevail 2-5-0: UNFAVORABLE ROLL CALL Yeas: Reps. Guerra, Hope. Nays: Reps. Calley, Sheppard, Hornberger, Marino, Paquette. Pass: None. Representative Marino moved to refer House Bill No. 5032 to the committee on Ways and Means, as amended, as substitute (H-2). The motion prevailed 5-2-0: FAVORABLE ROLL CALL Yeas: Reps. Calley, Sheppard, Hornberger, Marino, Paquette. Nays: Reps. Guerra, Hope. Pass: None.
