- HOUSE OF REPRESENTATIVES COMMITTEE ON LOCAL GOVERNMENT AND MUNICIPAL FINANCE REP. JAMES LOWER CHAIR COMMITTEE MEETING MINUTES Wednesday, January 22, 2020 12:00 PM Room 521, House Office Building The House Standing Committee on Local Government and Municipal Finance was called to order by Chair Lower. The Chair requested attendance be called: Present: Reps. Lower, Marino, Crawford, Calley, Howell, Eisen, Markkanen, Paquette, Ellison, Sowerby, Hope, Kuppa. Absent/Excused: Rep. Garza. Representative Crawford moved to adopt the meeting minutes from January 15, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5260 before the committee: HB 5260 (Rep. Paquette) A bill to amend 1945 PA 200, entitled "An act to define a marketable record title to an interest in land; to require the filing of notices of claim of interest in such land in certain cases within a definite period of time and to require the recording thereof; to make invalid and of no force or effect all claims with respect to the land affected thereby where no such notices of claim of interest are filed within the required period; to provide for certain penalties for filing slanderous notices of claim of interest, and to provide certain exceptions to the applicability and operation thereof," by amending section 4 (MCL 565.104), as amended by 2018 PA 572. Representative Paquette testified in support of HB 5260; Kevin Hirzel and Elizabeth Butler, representing the Community Associations Institute, testified in support of HB 5260. Questions and discussion followed. Brian Westrin and David Pierson, representing the Michigan Realtors, testified with a neutral position on HB 5260. Questions and discussion followed. The following people submitted a card in support of HB 5260, but did not wish to speak: Mark Petrie, representing The Meisner Law Group. Dave Worthams, representing the Michigan Bankers Association. The Chair laid HB 4030 before the committee: HB 4030 (Rep. Allor) A bill to amend 1972 PA 139, entitled "An act authorizing township boards to provide for the maintenance and improvement of private roads by contract and to provide payments by special assessment districts; and to repeal certain acts and parts of acts," by amending section 2 (MCL 247.392). Representative Allor testified in support of HB 4030. Questions and discussion followed. The following person submitted a card in support of HB 4030, but did not wish to speak: Judy Allen, representing the Michigan Townships Association. The Chair laid HB 5197 and HB 5198 before the committee: HB 5197 (Rep. Maddock) A bill to amend 1992 PA 116, entitled "Records reproduction act," (MCL 24.401 to 24.406) by adding section 2a. HB 5198 (Rep. Maddock) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 491 (MCL 750.491), as amended by 2017 PA 182. Representative Maddock testified in support of HB 5197 and 5198; David Scott, representing the Charter Township of Commerce, testified in support of HB 5197 and HB 5198. Questions and discussion followed. The following people submitted a card in support of HB 5197 and HB 5198, but did not wish to speak: Judy Allen, representing the Michigan Townships Association. Deena Bosworth, representing the Michigan Association of Counties. Representative Ellison moved to excuse Representative Garza from the meeting. There being no objection the motion prevailed by unanimous consent. There being no further business before the committee, Rep. James Lower adjourned the meeting at 12:32 PM.
