PAMELA HORNBERGER CHAIR COMMITTEE MEETING MINUTES Tuesday, January 28, 2020 9:00 AM Room 521, House Office Building The House Standing Committee on Education was called to order by Chair Hornberger. The Chair requested attendance be called: Present: Reps. Hornberger, Paquette, Crawford, Vaupel, Reilly, Hall, Markkanen, O'Malley, Wakeman, Camilleri, Sowerby, Brenda Carter, Tyrone Carter, Koleszar, Stone. Absent/Excused: None. Representative Vaupel moved to adopt the meeting minutes from January 14, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5236 before the committee: HB 5236 (Rep. Anthony) A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1538 (MCL 380.1538), as amended by 2007 PA 144. Representative O'Malley moved to refer House Bill No. 5236 to the committee on Military, Veterans and Homeland Security. The motion prevailed 15-0-0: FAVORABLE ROLL CALL Yeas: Reps. Hornberger, Paquette, Crawford, Vaupel, Reilly, Hall, Markkanen, O'Malley, Wakeman, Camilleri, Sowerby, Brenda Carter, Tyrone Carter, Koleszar, Stone. Nays: None. Pass: None. The Chair laid HB 4739 before the committee: HB 4739 (Rep. Berman) A bill to amend 1976 PA 451, entitled "The revised school code," (MCL 380.1 to 380.1852) by adding section 1263a. Representative Vaupel moved to adopt substitute (H-2) to HB 4739. The motion prevailed 15-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Representative Camilleri offered the following amendments to HB 4739 (H-2): 1. Amend page 1, line 2, after "year," by striking out the balance of the line through "A" on line 4 and inserting "a". 2. Amend page 1, line 4, after "district" by inserting "that receives funding under section 32d of the state school aid act of 1979, MCL 388.1632d, for a great start readiness program,". 3. Amend page 1, line 5, after "designee" by inserting a comma. 4. Amend page 1, line 5, after "each" by striking out "school". 5. Amend page 1, line 5, after "building" by striking out the balance of the line through "district" on line 8 and inserting "that will be utilized for a great start readiness program funded under section 32d of the state school aid act of 1979, MCL 388.1632d, for which the intermediate school district is the fiduciary under section 32d of the state school aid act of 1979, MCL 388.1632d,". 6. Amend page 2, line 2, by striking out all of subdivisions (b) and (c). 7. Amend page 2, line 14, after "of" by striking out "school". 8. Amend page 2, line 24, after "the" by striking out "school". 9. Amend page 2, line 25, after "any" by striking out "school". 10. Amend page 3, line 3, after "in" by striking out "subdivisions" and inserting "subdivision". 11. Amend page 3, line 3, after "(b)," by striking out the balance of the line through "(d)," on line 4. 12. Amend page 3, line 11, after "If" by striking out "an intermediate school district or school district" and inserting "a great start readiness program funded under section 32d of the state school aid act of 1979, MCL 388.1632d,". 13. Amend page 3, line 18, by striking out "intermediate school district or school district" and inserting "great start readiness program". 14. Amend page 3, line 20, by striking out all of subdivisions (c) and (d). 15. Amend page 4, line 7, after "If" by striking out "an intermediate school district or school district" and inserting "a great start readiness program funded under section 32d of the state school aid act of 1979, MCL 388.1632d,". 16. Amend page 4, line 14, after "completion." by striking out the balance of the line through "completion." on line 26. 17. Amend page 5, line 4, by striking out all of subsection (7) and renumbering the remaining subsection. Representative Camilleri spoke to his amendments. Representative Camilleri moved to adopt the amendments to HB 4739 (H-2). The motion did not prevail 6-9-0: UNFAVORABLE ROLL CALL Yeas: Reps. Camilleri, Sowerby, Brenda Carter, Tyrone Carter, Koleszar, Stone. Nays: Reps. Hornberger, Paquette, Crawford, Vaupel, Reilly, Hall, Markkanen, O'Malley, Wakeman. Pass: None. Representative Camilleri offered the following amendment to HB 4739 (H-2): 1. Amend page 5, following line 9, by inserting: "(8) The legislature shall appropriate sufficient funds from a fund identified on a list of funds submitted by the department of health and human services, excluding the state school aid fund established under section 11 of article IX of the state constitution of 1963, to only public schools to fully reimburse great start readiness programs that are located within school buildings operated by those public schools for the costs of contracting for the completion of modifications or remedial measures as described under this section, as applicable." and renumbering the remaining subsection. Representative Camilleri spoke to his amendment. Representative Camilleri moved to adopt the amendment to HB 4739 (H-2). The motion did not prevail 6-9-0: UNFAVORABLE ROLL CALL Yeas: Reps. Camilleri, Sowerby, Brenda Carter, Tyrone Carter, Koleszar, Stone. Nays: Reps. Hornberger, Paquette, Crawford, Vaupel, Reilly, Hall, Markkanen, O'Malley, Wakeman. Pass: None. Representative O'Malley moved to refer House Bill No. 4739 to the committee on Ways and Means, with recommendation as substitute (H-2). The motion prevailed 9-5-1: FAVORABLE ROLL CALL Yeas: Reps. Hornberger, Paquette, Crawford, Vaupel, Hall, Markkanen, O'Malley, Wakeman, Koleszar. Nays: Reps. Reilly, Sowerby, Brenda Carter, Tyrone Carter, Stone. Pass: Rep. Camilleri.
