- HOUSE OF REPRESENTATIVES COMMITTEE ON TAX POLICY REP. LYNN AFENDOULIS CHAIR COMMITTEE MEETING MINUTES Wednesday, February 19, 2020 10:30 AM Room 521, House Office Building The House Standing Committee on Tax Policy was called to order by Chair Afendoulis. At 10:33 AM, the Chair laid the committee at ease. At 10:35 AM, the Chair called the committee back to order. The Chair requested attendance be called: Present: Reps. Afendoulis, Lower, Vaupel, Webber, Farrington, Steven Johnson, Hall, O'Malley, Schroeder, Yancey, Wittenberg, Ellison, Lasinski, Robinson, Whitsett. Absent/Excused: None. Representative Schroeder moved to adopt the meeting minutes from February 5, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 269 before the committee: SB 269 (Sen. Geiss) A bill to amend 1941 PA 122, entitled "An act to establish the revenue collection duties of the department of treasury; to prescribe its powers and duties as the revenue collection agency of this state; to prescribe certain powers and duties of the state treasurer; to establish the collection duties of certain other state departments for money or accounts owed to this state; to regulate the importation, stamping, and disposition of certain tobacco products; to provide for the transfer of powers and duties now vested in certain other state boards, commissions, departments, and offices; to prescribe certain duties of and require certain reports from the department of treasury; to provide procedures for the payment, administration, audit, assessment, levy of interests or penalties on, and appeals of taxes and tax liability; to prescribe its powers and duties if an agreement to act as agent for a city to administer, collect, and enforce the city income tax act on behalf of a city is entered into with any city; to provide an appropriation; to abolish the state board of tax administration; to prescribe penalties and provide remedies; and to declare the effect of this act," (MCL 205.1 to 205.31) by adding section 4a. Representative Farrington moved to adopt substitute (H-3) to SB 269. The motion prevailed 15- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Afendoulis, Lower, Vaupel, Webber, Farrington, Steven Johnson, Hall, O'Malley, Schroeder, Yancey, Wittenberg, Ellison, Lasinski, Robinson, Whitsett. Nays: None. Pass: None. Representative Whitsett offered the following amendment to SB 269 (H-3): 1. Amend page 4, following line 9, by inserting: "(6) In addition to the requirements under part 1 of the income tax act of 1967, 1967 PA 281, MCL 206.1 to 206.532, for the 2021 tax year and each tax year after 2021, the department shall post on the department's website and include in the instruction booklet that accompanies the annual return both of the following: (a) A clear and concise statement informing the taxpayer that the taxpayer protection act requires a paid tax preparer to sign a return and provide his or her preparer tax identification number. (b) Contact information for the department's fraud unit." and renumbering the remaining subsections. Representative Whitsett spoke to her amendment. Representative Whitsett moved to adopt the amendment to SB 269 (H-3). The motion prevailed 15-0-0: FAVORABLE ROLL CALL Yeas: Reps. Afendoulis, Lower, Vaupel, Webber, Farrington, Steven Johnson, Hall, O'Malley, Schroeder, Yancey, Wittenberg, Ellison, Lasinski, Robinson, Whitsett. Nays: None. Pass: None. The following people submitted a card in support of SB 269, but did not wish to speak: Tyrone Sanders, representing H&R Block. Brandon Betz, representing the Michigan League for Public Policy. Representative Whitsett moved to refer Senate Bill No. 269 as amended, as substitute (H-4) to the committee on Ways and Means. The motion prevailed 14-1-0: FAVORABLE ROLL CALL Yeas: Reps. Afendoulis, Lower, Vaupel, Webber, Farrington, Hall, O'Malley, Schroeder, Yancey, Wittenberg, Ellison, Lasinski, Robinson, Whitsett. Nays: Rep. Steven Johnson. Pass: None. The Chair laid before the committee the following: Presentation from the Michigan Economic Development Corporation Amanda Bright-McClanahan, representing Michigan Economic Development Corporation, testified regarding the presentation. Questions and discussion followed. There being no further business before the committee, Chair Lynn Afendoulis adjourned the meeting at 11:25 AM.
