JAMES LOWER CHAIR COMMITTEE MEETING MINUTES Wednesday, February 26, 2020 12:00 PM Room 521, House Office Building The House Standing Committee on Local Government and Municipal Finance was called to order by Chair Lower. The Chair requested attendance be called: Present: Reps. Lower, Crawford, Calley, Howell, Eisen, Markkanen, Paquette, Ellison, Sowerby, Garza, Hope, Kuppa. Absent/Excused: Rep. Marino. Representative Crawford moved to adopt the meeting minutes from February 19, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4035 before the committee: HB 4035 (Rep. Ellison) A bill to prohibit a local unit of government from enacting or enforcing an ordinance, policy, resolution, or rule that regulates a dog based upon the breed or perceived breed of the dog; and to provide for the powers and duties of certain local governmental entities. The following person submitted a card in support of HB 4035, but did not wish to speak: Nathan Kark, representing the Michigan Department of Agriculture and Rural Development. Substitute (H-1) was previously adopted on February 19, 2020. Representative Ellison moved to refer House Bill No. 4035 to the Committee on Ways and Means, with recommendation as substitute (H-1). The motion prevailed 9-2-1: FAVORABLE ROLL CALL Yeas: Reps. Lower, Crawford, Calley, Eisen, Paquette, Ellison, Sowerby, Hope, Kuppa. Nays: Reps. Howell, Markkanen. Pass: Rep. Garza. The Chair laid SB 762 and HB 5434 before the committee: SB 762 (Sen. Horn) A bill to amend 1951 PA 33, entitled "An act to provide police and fire protection for townships and for certain areas in townships, certain incorporated villages, and certain cities; to authorize contracting for fire and police protection; to authorize the purchase of fire and police equipment, and the maintenance and operation of the equipment; to provide for defraying the cost of the equipment; to authorize the creation of special assessment districts and the levying and collecting of special assessments; to authorize the issuance of special assessment bonds in anticipation of the collection of special assessments and the advancement of the amount necessary to pay such bonds, and to provide for reimbursement for such advances by reassessment if necessary; to authorize the collection of fees for certain emergency services in townships and other municipalities; to authorize the creation of administrative boards and to prescribe their powers and duties; to provide for the appointment of traffic officers and to prescribe their powers and duties; and to repeal acts and parts of acts," by amending section 10 (MCL 41.810), as amended by 2004 PA 463. HB 5434 (Rep. At 12:14 PM, Minority Vice Chair Ellison called the committee back to order. The Minority Vice Chair laid HB 5504 before the committee: HB 5504 (Rep. Lower) A bill to amend 1956 PA 40, entitled "The drain code of 1956," by amending sections 196 and 434 (MCL 280.196 and 280.434), section 196 as amended by 2008 PA 509 and section 434 as amended by 2002 PA 406. Representative Lower and Stacy Hissong, representing the Michigan Association of County Drain Commissioners, testified in support of HB 5504. Questions and discussion followed. At 12:22 PM, Minority Vice Chair Ellison laid the committee at ease. At 12:23 PM, the Chair called the committee back to order. The following people submitted a card in support of HB 5504, but did not wish to speak: Nathan Kark, representing the Michigan Department of Agriculture and Rural Development. Joe Bush, representing the Michigan Association of County Drain Commissioners. The Chair laid HB 5126 before the committee: HB 5126 (Rep. S. Johnson) A bill to amend 1956 PA 40, entitled "The drain code of 1956," by amending sections 135 and 154 (MCL 280.135 and 280.154), section 135 as amended by 2017 PA 62 and section 154 as amended by 2018 PA 646. Representative Steve Johnson and Stacy Hissong, representing the Michigan Association of County Drain Commissioners, testified in support of HB 5126. Joe Bush, representing the Michigan Association of County Drain Commissioners, testified in support of HB 5126. The following person submitted a card in support of HB 5126, but did not wish to speak: Nathan Kark, representing the Michigan Department of Agriculture and Rural Development. Representative Eisen moved to excuse Representative Marino from the meeting. There being no objection the motion prevailed by unanimous consent.
