JACK O'MALLEY CHAIR COMMITTEE MEETING MINUTES Wednesday, May 27, 2020 8:30 AM Room 519, House Office Building The House Standing Committee on Transportation was called to order by Chair O'Malley. The Chair requested attendance be called: Present: Reps. O'Malley, Eisen, Cole, Sheppard, Alexander, Bellino, Howell, Afendoulis, Sneller, Haadsma. Absent/Excused: Reps. Clemente, Yancey, Shannon. Representative Sheppard moved to adopt the meeting minutes from May 19, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 518 and SB 519 before the committee: SB 518 (Sen. Runestad) A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to promote safe and efficient travel for motor vehicle drivers, bicyclists, pedestrians, and other legal users of roads, streets, and highways; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, local bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 10o (MCL 247.660o), as amended by 2000 PA 188. SB 519 (Sen. Senator Runestad, joined by Ed Noyola, representing the County Road Association of Michigan, testified in support of SB 518. Questions and discussion followed. Senator MacDonald testified in support of SB 519. Troy Hagon, joined by Director of the Bureau of Finance and Administration Patrick McCarthy, Director of the Bureau of Transportation Planning Todd White, and Manager of Statewide Planning Section Eric Mullen, all representing the Michigan Department of Transportation, testified in opposition to SB 518 and SB 519. Questions and discussion followed. Monica Ackerman, representing the Michigan Road Preservation Association, joined by Stewart Schwikert, representing Pavement Maintenance Systems, testified in opposition to SB 518 and SB 519. Questions and discussion followed. Senator Runestad and Ed Noyola approached to make additional testimony in support of the bills. Mueller) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending sections 317, 904, and 907 (MCL 257.317, 257.904, and 257.907), section 317 as amended by 2018 PA 566, section 904 as amended by 2018 PA 212, and section 907 as amended by 2015 PA 126. HB 5803 (Rep. Bolden) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16a of chapter IX (MCL 769.16a), as amended by 2008 PA 508. HB 5804 (Rep. Howell) A bill to amend 1925 PA 289, entitled "An act to create and maintain a fingerprint identification and criminal history records division within the department of state police; to require peace officers, persons in charge of certain institutions, and others to make reports respecting juvenile offenses, crimes, and criminals to the state police; to require the fingerprinting of an accused by certain persons; and to provide penalties and remedies for a violation of this act," by amending section 3 (MCL 28.243), as amended by 2018 PA 67. Representative Howell moved to refer House Bill No. 5802 to the Committee on Judiciary. The motion prevailed 10-0-0: FAVORABLE ROLL CALL Yeas: Reps.
