HANK VAUPEL CHAIR COMMITTEE MEETING MINUTES Tuesday, June 16, 2020 12:00 PM Room 352, House Appropriations, State Capitol Building The House Committee on Health Policy was called to order by Chair Vaupel. The Chair requested attendance be called: Present: Reps. Vaupel, Frederick, Alexander, Calley, Hornberger, Lower, Whiteford, Afendoulis, Filler, Mueller, Wozniak, Liberati, Clemente, Ellison, Koleszar, Pohutsky, Stone, Witwer. Absent: Rep. Garrett. Excused: Rep. Garrett. Representative Frederick moved to adopt the meeting minutes from June 9, 2020. There being no objection, the motion prevailed by unanimous consent. Representative Liberati moved to excuse Representative Garrett from the meeting. There being no objection the motion prevailed by unanimous consent. The Chair laid HCR 7 before the committee: HCR 7 (Rep. Whitsett) A concurrent resolution to urge the Centers for Disease Control and Prevention and the Michigan Department of Health and Human Services to protect the people of Michigan from Lyme disease by improving efforts to prevent, monitor, diagnose, and treat the disease. Representative Frederick moved to report out HCR 7 with recommendation. The motion prevailed 16-2-0: FAVORABLE ROLL CALL Yeas: Reps. Berman) A resolution to oppose the Governor's policies regarding the placement of COVID-19 patients into nursing homes. Representative Berman testified in support of HR 276. Meerman) A concurrent resolution to demand that the Governor compile and make publicly available certain data, to encourage medical professionals to provide elective medical procedures, and to encourage the people of Michigan to continue to practice safe social distancing. The Chair laid HB 5832 before the committee: HB 5832 (Rep. Whiteford) A bill to amend 1974 PA 258, entitled "Mental health code," by amending sections 100a, 100b, 161, 409, and 439 (MCL 330.1100a, 330.1100b, 330.1161, 330.1409, and 330.1439), section 100a as amended by 2018 PA 595, section 100b as amended by 2014 PA 200, section 161 as amended by 2012 PA 500, section 409 as amended by 2018 PA 593, and section 439 as added by 1986 PA 118, and by adding chapter 9A. Representative Whiteford testified in support of HB 5832. The following people submitted a card in support of HB 5832, but did not wish to speak: Emily Schwarzkopf, representing the Michigan Department of Health and Human Services. Jim Blundo, representing the Michigan Mental Health Counselors Association. The following people submitted a card in opposition to HB 5832, but did not wish to speak: Sherri Boyd, representing the The Arc of Michigan. Robert Kosowski, representing the Michigan Psychiatric Society. Representative Whiteford offered the following amendments to HB 5832: 1. Amend page 16, line 22, after "treatment." by inserting "Crisis services at a crisis stabilization unit must entail an initial psychosocial assessment by a master's level mental health professional and a psychiatric evaluation within 24 hours to stabilize the individual.". 2. Amend page 16, line 24, after "hours" by striking out "unless 1 of the following applies:" and inserting a comma and "after which the individual must be provided with the clinically appropriate level of care, resulting in 1 of the following:". 3. Amend page 16, line 26, by striking out the balance of the page through "services." on line 1 of page 17 and inserting: "(b) A referral to outpatient services for aftercare treatment. (c) A referral to a partial hospitalization program. (d) A referral to a residential treatment center, including crisis residential services. (e) A referral to an inpatient bed." and relettering the remaining subdivision. 4. Amend page 18, following line 16, by inserting: "(3) A psychiatric hospital or general hospital may establish and operate a crisis stabilization unit under this chapter. As used in this subsection, "general hospital" means hospital as that term is defined in section 20106 of the public health code, 1978 PA 368, MCL 333.20106.". 5. Amend page 18, following line 27, by inserting: "(d) Standards to prevent inappropriate referral between entities of common ownership." and relettering the remaining subdivisions. 6. Amend page 18, line 29, after "unit" by inserting "with discharge planning upon intake to a clinically appropriate level of care consistent with section 409(7)". 7. Amend page 19, following line 5, by inserting: "(i) Standards requiring a minimum amount of face-to-face psychiatric supervision of an individual receiving services in the crisis stabilization unit that are consistent with the face-to-face supervision requirements applicable in a psychiatric hospital or psychiatric unit setting." and relettering the remaining subdivisions. 8. Amend page 20, line 5, after "chapter." by striking out the balance of the subsection. Representative Whiteford moved to adopt the amendments to HB 5832. The motion prevailed 18-0-0: FAVORABLE ROLL CALL Yeas: Reps.
