- HOUSE OF REPRESENTATIVES COMMITTEE ON COMMERCE AND TOURISM REP. STEVE MARINO CHAIR COMMITTEE MEETING MINUTES Wednesday, June 17, 2020 9:00 a.m. Room 519, House Office Building The House Committee on Commerce and Tourism was called to order by the Chair. The Chair requested attendance be called: Present: Reps. Marino, Wendzel, Reilly, Schroeder, Wakeman, Wozniak, Cambensy, Camilleri, Sowerby, Hope, Manoogian. Absent: None. Excused: None. Representative Wendzel moved to adopt the meeting minutes from June 10, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5770 before the committee: HB 5770 (Rep. Mueller) A bill to amend 1976 PA 331, entitled "Michigan consumer protection act," by amending sections 3, 5, and 11 (MCL 445.903, 445.905, and 445.911), section 3 as amended by 2018 PA 211 and section 5 as amended by 2006 PA 508, and by adding section 3l. Representative Mike Mueller, the bill sponsor, explained HB 5770. Questions followed. John McNamara, Vice-President of Government Affairs for Michigan Restaurant and Lodging Association, testified in support of HB 5770. Questions followed. Tyler Diers, Executive Director, Midwest and TechNet submitted a card in opposition to HB 5770, and did not wish to speak, but did submit written testimony, which is attached. Justin Winslow, President and Chief Executive Officer for the Michigan Restaurant and Logging Association, submitted a card in support of HB 5770. The Chair laid HB 5623 before the committee: HB 5623 (Rep. O'Malley) A bill to amend 1969 PA 312, entitled "An act to provide for compulsory arbitration of labor disputes in municipal police and fire departments; to define such public departments; to provide for the selection of members of arbitration panels; to prescribe the procedures and authority thereof; and to provide for the enforcement and review of awards thereof," by amending section 2 (MCL 423.232), as amended by 2011 PA 116. Steve Delie, Director of Labor Policy and Workers for Opportunity at the Mackinac Center for Public Policy, testified in opposition to HB 5623, and submitted written testimony, which is attached. Questions followed. David Guenthner, Senior Strategist for State Affairs at the Mackinac Center for Public Policy, submitted a card in opposition to HB 5623, but did not wish to speak. Representative Cambensy moved to refer House Bill No. 5623 to the Committee on Ways and Means. The motion prevailed 9-1-1: FAVORABLE ROLL CALL Yeas: Reps. Marino, Wendzel, Schroeder, Wakeman, Wozniak, Camilleri, Sowerby, Hope, Manoogian. Nays: Rep. Reilly. Pass: Rep. Cambensy. The Chair laid HB 5672 before the committee: HB 5672 (Rep. Kahle) A bill to prohibit employers from requiring employees and prospective employees to have devices implanted or otherwise incorporated into their bodies as a condition of employment or any employment benefit; to prohibit employers from discriminating in the terms, conditions, and benefits of employment against employees who refuse to have a device implanted or otherwise incorporated into their bodies; and to provide remedies. Lee Gonzales, Deputy Director of Legislative and External Affairs at the Michigan Department of Civil Rights, submitted a card in support of HB 5672, but did not wish to speak. Representative Schroeder moved to refer House Bill No. 5672 to the Committee on Ways and Means. The motion prevailed 11-0-0: FAVORABLE ROLL CALL Yeas: Reps. Marino, Wendzel, Reilly, Schroeder, Wakeman, Wozniak, Cambensy, Camilleri, Sowerby, Hope, Manoogian. Nays: None. Pass: None. The Chair laid HB 4954, HB 4955 and HB 4956 before the committee: HB 4954 (Rep. Marino) A bill to amend 1984 PA 431, entitled "The management and budget act," (MCL 18.1101 to 18.1594) by adding section 266. HB 4955 (Rep. Marino) A bill to amend 1984 PA 431, entitled "The management and budget act," (MCL 18.1101 to 18.1594) by adding section 262a. HB 4956 (Rep. Marino) A bill to amend 1984 PA 431, entitled "The management and budget act," by amending section 264 (MCL 18.1264), as added by 1988 PA 504. Barry Szczesny, Legislative Assistant to Chairman Marino, the bill sponsor, explained HB 4954, HB 4955. and HB 4956 to committee members. Bree Anderson, Legislative Liaison and Policy Advisor for the Michigan Department of Technology, Management and Budget, and Jim Colongelo, Chief Procurement Officer for the Michigan Department of Technology, Management and Budget, testified in opposition to HB 4954, HB 4955, and HB 4956. There being no further business before the committee, Representative Wakeman moved to adjourn.
