- HOUSE OF REPRESENTATIVES COMMITTEE ON JUDICIARY REP. GRAHAM FILLER CHAIR COMMITTEE MEETING MINUTES Wednesday, July 22, 2020 8:30 AM Room 519, House Office Building The House Committee on Judiciary was called to order by Chair Filler. The Chair requested attendance be called: Present: Reps. Filler, LaFave, Farrington, Howell, Steven Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Yancey, Bolden. Absent: None. Excused: None. Representative Howell moved to adopt the meeting minutes from June 24, 2020. There being no objection, the motion prevailed by unanimous consent. At 8:34 AM, the Chair laid the committee at ease. At 8:37 AM, the Chair called the committee back to order. The Chair laid SB 899 before the committee: SB 899 (Sen. MacDonald) A bill to amend 1976 PA 390, entitled "Emergency management act," by amending section 11 (MCL 30.411), as amended by 2005 PA 321. The following people submitted a card in support of SB 899, but did not wish to speak: Mary Kay Makarewicz, representing the Michigan Society of Hematology and Oncology. Evie Zois Sweeney, representing the American Nurses Association-MI. Sarah Waun, representing the Michigan State Medical Society. Gabe Schneider, representing Munson Healthcare. Dalton Herbel, representing LeadingAge Michigan. Alisha Cottrell and Rachel Kelley, both representing Ascension Michigan. Sean Gehle, representing Trinity-Health Michigan. Dyck Van Koevering, representing the Insurance Alliance of Michigan. The following people submitted a card in opposition to SB 899, but did not wish to speak: Bill Flory, representing the Michigan Association for Justice. Representative LaFave moved to adopt substitute (H-1) to SB 899. The motion prevailed 13- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, Steven Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Yancey, Bolden. Nays: None. Pass: None. Representative LaFave explained the proposed amendments to SB 899 (H-1). Representative LaFave offered the following amendments to SB 899 (H-1): 1. Amend page 4, line 29, by striking out "emergency or disaster" and inserting "pandemic". 2. Amend page 7, line 18, after "disaster" by inserting "or the period specified in subsection (7)". Representative LaFave moved to adopt the amendments to SB 899 (H-1). The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Howell, Steven Johnson, Rendon, Berman, Wozniak, LaGrand, Guerra, Elder, Yancey, Bolden. Nays: None. Pass: None. Representative Guerra explained the proposed amendment to SB 899 (H-1). Representative Guerra offered the following amendment to SB 899 (H-1): 1. Amend page 7, following line 25, by inserting: "Enacting section 1. This amendatory act does not take effect unless House Bill No. 5628 of the 100th Legislature is enacted into law.". Representative Guerra moved to adopt the amendment to SB 899 (H-1). The motion did not prevail 6-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Howell, LaGrand, Guerra, Elder, Yancey, Bolden. Nays: Reps. Filler, LaFave, Farrington, Steven Johnson, Rendon, Berman, Wozniak. Pass: None. Representative LaGrand offered the following amendment to SB 899 (H-1): 1. Amend page 7, following line 25, by inserting: "Enacting section 1. This amendatory act does not take effect unless House Bill No. 5758 of the 100th Legislature is enacted into law.". Representative LaGrand moved to adopt the amendment to SB 899 (H-1). The motion did not prevail 5-7-1: UNFAVORABLE ROLL CALL Yeas: Reps. LaGrand, Guerra, Elder, Yancey, Bolden. Nays: Reps. Filler, LaFave, Farrington, Howell, Steven Johnson, Rendon, Wozniak. Pass: Rep. Berman. Discussion was held between committee members. Representative LaFave moved to report Senate Bill No. 899 as amended, as substitute (H-2). The motion prevailed 7-6-0: FAVORABLE ROLL CALL Yeas: Reps. Filler, LaFave, Farrington, Steven Johnson, Rendon, Berman, Wozniak. Nays: Reps. Howell, LaGrand, Guerra, Elder, Yancey, Bolden. Pass: None. There being no further business before the committee, Rep.
