BRANDT IDEN CHAIR COMMITTEE MEETING MINUTES Wednesday, July 22, 2020 10:30 AM Room 519, House Office Building The House Committee on Ways and Means was called to order by Chair Iden. The Chair requested attendance be called: Present: Reps. Iden, Lilly, Griffin, Hauck, Kahle, Meerman, Warren, Byrd, Hertel, Bolden. Absent: Rep. Leutheuser. Excused: Rep. Leutheuser. Representative Lilly moved to adopt the meeting minutes from June 24, 2020. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 956 before the committee: SB 956 (Sen. Lucido) A bill to amend 1978 PA 368, entitled "Public health code," by amending section 21717 (MCL 333.21717), as amended by 2014 PA 66, and by adding section 5145. Senator Lucido testified in support of SB 956. Representative Love testified in opposition to SB 956. The Chair laid HB 5910, HB 5911, HB 5912 and HB 5913 before the committee: HB 5910 (Rep. (B) Teachers are provided with moveable plastic or plexiglass partitions. Representative Iden moved to adopt the amendment to HB 5912 (H-3). Representative Warren offered the following amendments to SB 956 (H-3): 1. Amend page 2, line 6, after "shall" by striking out "describe" and inserting "do both of the following: (a) Describe". 2. Amend page 2, line 11, following "facility." by inserting: "(b) Provide for all of the following: (i) Twenty-four hour notice to the individual, the individual's family members, or the individual's legal representative regarding the transfer of the individual to a dedicated facility described in subdivision (a). (ii) The ability for an individual described in subparagraph (i) to have a choice in the location of the transfer. (iii) The ability for an individual described in subparagraph (i) to appeal a decision regarding the transfer to a dedicated facility described in subdivision (a). The department shall develop an appeals process for purposes of this subparagraph that includes a time frame to file an appeal and that designates where the individual who is the subject of the transfer may reside while the appeal is pending. (3)" and renumbering the remaining subsection. 3. Amend page 2, line 12, after "under" by striking out "this subsection," and inserting "subsection (2),". Representative Warren moved to adopt the amendments to SB 956 (H-3). The motion did not prevail 4-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Warren, Byrd, Hertel, Bolden. Nays: Reps. Iden, Lilly, Griffin, Hauck, Kahle, Meerman. Pass: None. Representative Warren offered the following amendments to SB 956 (H-3): 1. Amend page 2, line 6, after "shall" by striking out "describe" and inserting "do both of the following: (a) Describe". 2. Amend page 2, line 11, following "facility." by inserting: "(b) Include both of the following: (i) That if an individual tests positive for coronavirus and needs to be transferred to a dedicated facility described in subdivision (a), a physician shall provide, in writing and in a time frame and manner determined by the department, that the individual is medically stable for the transfer to the dedicated facility. The plan must specify where the individual may reside while awaiting a physician's determination. (ii) That the individual be transferred to a dedicated facility described in subdivision (a) by a paramedic as that term is defined in section 20908. (3)" and renumbering the remaining subsection. 3. Amend page 2, line 12, after "under" by striking out "this subsection," and inserting "subsection (2),". Representative Warren moved to adopt the amendments to SB 956 (H-3). The motion did not prevail 4-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Warren, Byrd, Hertel, Bolden. Nays: Reps. Iden, Lilly, Griffin, Hauck, Kahle, Meerman. Pass: None.
