GARY HOWELL CHAIR COMMITTEE MEETING MINUTES Wednesday, September 23, 2020 10:30 AM Room 519, House Office Building The House Committee on Natural Resources and Outdoor Recreation was called to order by Chair Howell. The Chair requested attendance be called: Present: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen, Sowerby, Cambensy, Pohutsky. Absent: None. Excused: None. Representative Cambensy moved to adopt the minutes from the September 15th, 2020 meeting. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5829 before the committee: HB 5829 (Rep. Cambensy) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 1905 (MCL 324.1905), as amended by 2012 PA 619. The following people submitted a card in support of HB 5829, but did not wish to speak: Deena Bosworth, representing the Michigan Association of Counties. The Chair laid HB 5762 before the committee: HB 5762 (Rep. Griffin) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 5301, 5403, 5405, and 5406 (MCL 324.5301, 324.5403, 324.5405, and 324.5406), section 5301 as amended by 2012 PA 560, sections 5403 and 5405 as added by 1997 PA 26, and section 5406 as amended by 2012 PA 561. Representative Griffin testified in support of HB 5762. Representative Cambensy offered the following amendment to HB 5762: 1. Amend page 9, following line 11, by inserting: "(f) Assurances that at least 50% of the labor force to be used on the project resides within 100 miles of the planning area boundaries of the project.". Representative Cambensy moved to adopt the amendment to HB 5762. The motion did not prevail 3-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Sowerby, Cambensy, Pohutsky. Nays: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen. Pass: None. Representative Cambensy offered the following amendment to HB 5762: 1. Amend page 9, following line 11, by inserting: "(f) Identification of contractors and subcontractors that may be used on the project. Any contractor or subcontractor identified under this subdivision must be registered with the United States Department of Labor Office of Apprenticeship.". Representative Cambensy moved to adopt the amendment to HB 5762. The motion did not prevail 3-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Sowerby, Cambensy, Pohutsky. Nays: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen. Pass: None. Representative Cambensy offered the following amendment to HB 5762: 1. Amend page 12, following line 1, by inserting: "(f) A demonstration that at the public hearing all alternative funding mechanisms were discussed and the reason or reasons for the rejection of the alternative funding mechanisms was given.". Representative Cambensy moved to adopt the amendment to HB 5762. The motion did not prevail 3-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Sowerby, Cambensy, Pohutsky. Nays: Reps. Howell, Wakeman, Calley, Reilly, Rendon, Eisen. Pass: None. Representative Eisen moved to refer House Bill No. 5762 to the Committee on Ways and Means. The Chair laid HB 5485 before the committee: HB 5485 (Rep. O'Malley) A bill to create the flooding and soil erosion task force within the department of natural resources and to prescribe its powers and duties; and to prescribe the powers and duties of certain state departments and officers. Representative O'Malley testified in support of HB 5485. Questions and discussion followed. Travis Boeskool and Theresa Seidel, representing the Department of Environment, Great Lakes & Energy, testified in opposition to HB 5485. Questions and discussion followed.
