Evidence text: HOUSE STANDING COMMITTEE ON APPROPRIATIONS Tuesday June 5 th , 2019 9:00 a.m. Room 352 State Capitol Building Representative Hernandez, Chair, called the meeting to order. The Clerk read a letter from Speaker Chatfield appointing Representative Sheppard to the committee. Chair Hernandez requested attendance be called to establish a quorum of the appointed committee members: Present: Reps. Hernandez, Miller, Sheppard, Albert, Allor, Brann, VanSingel, Whiteford, Yaroch, Bollin, Glenn, Green, Huizenga, Lightner, Maddock, Slagh, VanWoerkom, Hoadley, Pagan, Hammoud, Peterson, Sabo, Anthony, Brixie, Cherry, Hood, Kennedy, and Tate. Absent: Rep. Love. Excused: Rep. Love. Representative Sheppard moved to approve the minutes of the May 22nd, 2019, meeting. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4231 before the committee: HB 4231 (Rep. Albert) Appropriations; zero budget; corrections; provide for fiscal year 2019-2020. Representative Albert moved to adopt substitute (H-2) for HB 4231. The committee discussed the proposed substitute (H-2). Robin Risko, representing the House Fiscal Agency, joined the discussion. Amend page 64, following line 2, by inserting: “ONE-TIME APPROPRIATIONS Sec. 1100. From the funds appropriated in part 1 for new custody staff training, the department shall increase the training capacity for new custody staff. The purpose of additional academies is to address higher than normal attrition of correction officers and to decrease overtime costs.”. The director shall take all reasonable steps to ensure businesses in deprived and depressed communities compete for and perform contracts to provide services or supplies, or both. The director shall strongly encourage firms with which the department contracts to subcontract with certified businesses in deprived and depressed communities for services, supplies, or both.”. 2. Amend page 29, following line 8, by inserting: “Sec. 313a. The department shall work with organizations that promote minorities and women to recruit more minority and female corrections officers to help increase the diversity of the state’s corrections officers’ workforce. The department shall submit quarterly reports on the department’s efforts to recruit minority and female officers, and on the diversity of the corrections officer training academies. The reports shall be submitted to the senate and house appropriations subcommittees on corrections, the senate and house fiscal agencies, the legislative corrections ombudsman, and the state budget office.”. Representative Anthony explained the amendments. Representative Anthony moved to adopt the amendments for HB 4231, as substitute (H-2). The motion did not prevail by a vote of 11-17-0. Amend page 28, following line 9, by inserting: “(3) It is the intent of the legislature that the department resume staff line-ups, which require corrections officers to report not less than 6 minutes before start time for a shift so that custody supervisors can share relevant information about the preceding shift, including security, safety, drug, or violence issues, and can evaluate the mental, emotional, and physical fitness of corrections officers reporting to assume duties of the shift.” and renumbering remaining subsection. Representative Sabo explained the amendment. Representative Sabo moved to adopt the amendment for HB 4231, as substitute (H-2). The motion did not prevail by a vote of 11-17-0. (1) Funds appropriated in part 1 for Goodwill Flip the Script shall be distributed to a Michigan-chartered 501(c)(3) nonprofit corporation operating in a county with greater than 1,500,000 people for administration and expansion of a program which serves a population of persons aged 16 to 39. The program shall target those who are entering the criminal justice system for the first or second time and shall assist those individuals through the following program types: (a) Alternative sentencing programs in partnership with a local district or circuit court. (b) Educational recovery for special adult populations with high rates of illiteracy. (c) Career development and continuing education for women. (2) The program selected shall report by March 30 to the department, the senate and house appropriations subcommittees on corrections, the senate and house fiscal agencies, the legislative corrections ombudsman, and the state budget office. The report shall include program performance measurements, the number of individuals diverted from incarceration, the number of individuals served, and outcomes of participants who complete the program.”. Representative Tate explained the amendments. Representative Tate moved to adopt the amendments for HB 4231, as substitute (H-2). The motion did not prevail by a vote of 11-17-0.
