BOX 30036 LANSING, MICHIGAN 48909-7536 PHONE: (517) 373-2420 FAX: (517) 373-2764 COMMITTEE MEETING MINUTES May 15, 2019 A meeting of the Senate Committee on Insurance and Banking was scheduled for Tuesday, May 7, 2019, at 9:00 a.m., in the 1100 Room of the Binsfeld Building. The agenda summary is as follows: 1. Reported SB 305 (S-1) (Sen. Hollier) with recommendation and immediate effect. The Chairwoman called the meeting to order at 9:04 a.m. She instructed the clerk to call the roll. At that time, the following members were present: Chairwoman Theis, Sen.(s) Lauwers, LaSata, Nesbitt, Daley, Barrett, Horn, Geiss, Bullock, and McMorrow, a quorum was present. The Chairwoman entertained a motion by Sen. LaSata to adopt the meeting minutes from May 7, 2019. Without objection, the minutes were adopted. The Chairwoman invited Sen. Hollier to summarize SB 305. The Chairwoman recessed the committee from 9:15 a.m. until 9:18 a.m. The Chairwoman asked the Clerk to read the testimony cards of those individuals not wishing to testify before the committee regarding SB 305: Nancy Adams, Citizen – Oppose Erin Gust, Clients and Staff Dignitas – Oppose Britney Malacara-Haymon, Citizen – Oppose Kelly Whalen, CPAN – Oppose Shannon Lambert, Dignitas – Oppose Jose Bocanegra, Dignitas – Oppose Aaron Klassen, Galaxy Brain and Therapy Center – Oppose Evan Yates, Work Skills Corp – Oppose Amy Sheibar, Work Skills Corporation – Oppose Deborah Roels, Work Skills Corporation – Oppose Kimberly Nolan, Progressive Alternatives – Oppose Andrew Mac, AMAC Pharmacy Services – Oppose Tamara Ragon, Inspire Home Care – Oppose Tim Hoste, Michigan Brain Injury Provider Council – Oppose Kevin McKinney, CPAN – Oppose Jeffrey Junkas, American Property Casualty Insurance Association – Oppose Page 1 of 2 Mirta Van Etten, CPAN – Oppose Victoria Calhoun, CPAN – Oppose Bobby Thomas, CPAN – Oppose Stephanie Guzak, Dignitas – Oppose The Chairwoman recessed the committee from 9:21 a.m. until 9:25 a.m. Sen. Lauwers offered an (S-1) substitute to SB 305. The Chairwoman entertained a motion by Sen. Lauwers to adopt the (S-1) version of SB 305. The vote was as follows: Yeas: Chairwoman Theis, Sen.(s) Lauwers, LaSata, Nesbitt, Daley, Barrett, Horn, and Geiss, Bullock, and McMorrow. Nays: None. The motion prevailed and the (S-1) was adopted. The Chairwoman invited Sen. McMorrow to summarize amendment #1 to the (S-1) of SB 305. The Chairwoman entertained a motion by Sen. McMorrow to adopt amendment #1 to the (S-1) version of SB 305. The vote was as follows: Yeas: Sen.(s) Geiss, Bullock, and McMorrow. Nays: Chairwoman Theis, Sen.(s) Lauwers, LaSata, Nesbitt, Daley, Barrett, and Horn. The motion failed and the amendment was not adopted. The Chairwoman invited Sen. Geiss to summarize amendment #2 to the (S-1) of SB 305. The Chairwoman entertained a motion by Sen. Geiss to adopt amendment #2 to the (S-1) version of SB 305. The vote was as follows: Yeas: Sen.(s) Geiss, Bullock, and McMorrow. Nays: Chairwoman Theis, Sen.(s) Lauwers, LaSata, Nesbitt, Daley, Barrett, and Horn. The motion failed and the amendment was not adopted. The Chairwoman entertained a motion by Sen. Nesbitt to report SB 305 (S-1) to the floor with recommendation that it pass. The vote was as follows: Yeas: Chairwoman Theis, Sen.(s) Lauwers, LaSata, Nesbitt, Daley, Barrett, and Horn Nays: None. Pass: Sen.(s) Geiss, Bullock, McMorrow The motion prevailed and the bill was reported. The Chairwoman moved for immediate effect for SB 305. Without objection, immediate effect was recommended. There being no further business before the committee, the Chairwoman moved to adjourn the committee.
