BOX 30036 LANSING, MICHIGAN 48909-7536 PHONE: (517) 373-0793 FAX: (517) 373-5607 COMMITTEE MEETING MINUTES October 15, 2019 A meeting of the Senate Committee on Regulatory Reform was scheduled for Tuesday, October 15, 2019, at 3:00 p.m., in the 1200 Room of the Binsfeld Office Building. The agenda summary is as follows: 1. Reported SB 434 (S-1) (Sen. Nesbitt) with recommendation and immediate effect. 2. Reported SB 543 (S-1) (Sen. VanderWall) with recommendation and immediate effect. 3. Reported SB 349 (Sen. VanderWall) with recommendation and immediate effect. The Chair called the meeting to order at 3:04 p.m. He instructed the clerk to call the roll. At that time, the following members were present: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki and Wojno; a quorum was present. The Chair entertained a motion by Sen. VanderWall to adopt the meeting minutes from October 8, 2019. Without objection, the minutes were adopted. The Chair read the cards of those individuals not wishing to testify before the committee regarding SB 434: Derek Sova, Michigan Department of Licensing and Regulatory Affairs – Support Sen. Theis offered an (S-1) substitute to SB 434. The Chair entertained a motion by Sen. Theis to adopt the (S-1) version of SB 434. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, Wojno. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. Theis to report the (S-1) version of SB 434 to the floor with recommendation that it pass. The vote was as follows: Page 1 of 3 Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Moss, Polehanki, Wojno. Nays: None Pass: Sen. Zorn. The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 434. Without objection, immediate effect was recommended. The Chair read the cards of those individuals not wishing to testify before the committee regarding SB 543: Brett Visner, Michigan Beer and Wine Wholesalers Association – Neutral Scott Ellis, Michigan Licensed Beverage Association – Support Kerry Krone, Michigan Liquor Control Commission – No Position Sen. VanderWall offered an (S-1) substitute to SB 543. The Chair entertained a motion by Sen. VanderWall to adopt the (S-1) version of SB 543. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Lauwers, VanderWall, Zorn, Moss, Polehanki, Wojno. Nays: None Pass: Sen. Johnson. The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. VanderWall to report the (S-1) version of SB 543 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Lauwers, VanderWall, Zorn, Polehanki, Wojno. Nays: Sen.(s) Theis, Johnson, Moss. The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 543. Without objection, immediate effect was recommended. The Chair read the cards of those individuals not wishing to testify before the committee regarding SB 349: Brett Visner, Michigan Beer and Wine Wholesalers Association – Neutral Brendan Ringlever, Michigan Spirits Association – Opposition Scott Ellis, Michigan Licensed Beverage Association – Support Kerry Krone, Michigan Liquor Control Commision – Opposition Jon O'Connor, Michigan Craft Distillers Association – Support Sen. Polehanki offered an amendment to SB 349, identified as Amendment #1. The Chair entertained a motion by Sen. Polehanki to adopt Amendment #1 to SB 349. The vote was as follows: Yeas: Sen.(s) Moss, Polehanki, Wojno. Page 2 of 3 Nays: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn. The motion failed and the amendment was not adopted. The Chair entertained a motion by Sen. VanderWall to report SB 349 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Lauwers, VanderWall, Moss, Wojno. Nays: Sen. Polehanki. Pass: Sen.(s) Johnson, Zorn. The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 349. Without objection, immediate effect was recommended. There being no further business before the committee, the Chair moved to adjourn the committee.
