BOX 30036 LANSING, MICHIGAN 48909-7536 PHONE: (517) 373-7670 FAX: (517) 373-5958 COMMITTEE MEETING MINUTES January 16, 2020 A meeting of the Senate Committee on Judiciary and Public Safety was scheduled for Thursday, January 16, 2020, at 8:30 a.m., in the 1100 Room of the Binsfeld Office Building. The agenda summary is as follows: 1. Reported SB 68 (S-1) (Sen. Wojno) with recommendation and immediate effect. 2. Reported HB 5117 (S-1) (Rep. Kyra Bolden) with recommendation and immediate effect. 3. Reported HB 5118 (S-1) (Rep. Julie Calley) with recommendation and immediate effect. 4. Presentation from the Michigan State Police regarding Datamaster validation. The Chair called the meeting to order at 8:34 a.m. He instructed the Clerk to call the roll. At that time, the following members were present: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang and Irwin, a quorum was present. The Chair entertained a motion by Sen. VanderWall to adopt the meeting minutes from December 11, 2019. Without objection, the minutes were adopted. The Chair brought up SB 68, HB 5117 and HB 5118. Sen. Chang offered an (S-1) version of SB 68 and HB 5117, and Sen. VanderWall offered an (S-1) version of HB 5118. The Chair entertained a motion by Sen. Chang to adopt the (S-1) version of SB 68. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. Chang to adopt the (S-1) version of HB 5117. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. VanderWall to adopt the (S-1) version of HB 5118. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the (S-1) was adopted. The cards were read of those individuals not wishing to testify before the committee regarding SB 68, HB 5117 and HB 5118: Noah Smith, Criminal Defense Attorneys of Michigan – Support John Cooper, Safe and Just Michigan – Support Megan Richardson, Michigan Innocence Clinic – Support Peter Cunningham, State Bar of Michigan – Support The Chair entertained a motion by Sen. Chang to report the (S-1) version of SB 68 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 68. Without objection, immediate effect was recommended. The Chair entertained a motion by Sen. Irwin to report the (S-1) version of HB 5117 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for HB 5117. Without objection, immediate effect was recommended. The Chair entertained a motion by Sen. VanderWall to report the (S-1) version of HB 5118 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sens. VanderWall, Barrett, Johnson, Runestad, Chang, and Irwin. Nays: None The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for HB 5118. Without objection, immediate effect was recommended. The Chair invited the following individuals to give the Committee a presentation regarding Datamaster validation and the contract with Intoximeters Inc. Member questions and discussion followed.
