BOX 30036 LANSING, MICHIGAN 48909-7536 PHONE: (517) 373-7670 FAX: (517) 373-5958 COMMITTEE MEETING MINUTES June 4, 2020 A meeting of the Senate Committee on Judiciary and Public Safety was scheduled for Thursday, June 4, 2020, at 8:30 a.m., in the Harry T. Gast Appropriations Room, 3rd Floor, Capitol Building. The agenda summary is as follows: 1. Reported SB 945 (S-1) (Sen. Irwin) with recommendation and immediate effect. 2. A presentation overview of expungement in Michigan. The Chair called the meeting to order at 8:36 a.m. He instructed the Clerk to call the roll. At that time, the following members were present: Chair Lucido, Sen (s). VanderWall, Barrett, Johnson, Runestad, Chang and Irwin, a quorum was present. The Chair entertained a motion by Sen. Barrett to adopt the meeting minutes from May 19, 2020. Without objection, the minutes were adopted. The Chair invited Sen. Irwin to summarize SB 945. The Chair invited Sen. Runestad to summarize amendment #1 to SB 945. The Chair invited Sen. Chang to summarize amendment #2 to SB 945. The Chair invited Sheriff Jerry Clayton of Washtenaw County, Michigan to testify via Zoom in support of SB 945. The cards were read of those individuals not wishing to testify before the committee regarding SB 945: Sgt. Runestad to adopt amendment #1 to SB 945. The vote was as follows: Yeas: Chair Lucido, Sen.(s) VanderWall, Barrett, Johnson, Runestad, Chang and Irwin Nays: None The motion prevailed and the amendment was adopted. The Chair entertained a motion by Sen. Chang to adopt amendment #2 to SB 945. The vote was as follows: Yeas: Chair Lucido, Sen.(s) VanderWall, Johnson, Runestad, Chang and Irwin Nays: Sen. Barrett The motion prevailed and the amendment was adopted. The Chair entertained a motion by Sen. Irwin to report SB 945, as amended, as a clean substitute, to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sen.(s) VanderWall, Barrett, Johnson, Runestad, Chang and Irwin Nays: None The motion prevailed and the bill was reported. The Chair moved to recommend immediate effect for SB 945. Without objection, immediate effect was recommended. The Chair invited Rep.(s) Filler and LaGrand to present an overview of expungement in Michigan. The Chair invited the following individuals to present testimony via Zoom regarding expungement in Michigan: Sharon Dietrich, Community Legal Services of Philadelphia's Employment Unit. Sonja Starr, University of Michigan Law Professor JJ Prescott, University of Michigan Law Professor The Chair invited the following individuals to present testimony regarding expungement in Michigan: Dan Ross, United Felons Organization The following cards were read of those individuals no wishing to present testimony regarding expungement in Michigan: Tesharra Smith, Citizen – Supports felony expungement There being no further business before the committee, the Chair moved to adjourn the committee.
