BOX 30036 LANSING, MICHIGAN 48909-7536 PHONE: (517) 373-7670 FAX: (517) 373-5958 COMMITTEE MEETING MINUTES July 29, 2020 A meeting of the Senate Committee on Judiciary and Public Safety was scheduled for Thursday, July 29, 2020, at 8:30 a.m., in room 1100 of the Binsfeld Office Building. The agenda summary is as follows: 1. Testimony only SB 111 (S-1) (Sen. Lucido). 2. Reported SB 681 (S-2) (Sen. Irwin) with recommendation and immediate effect. 3. Reported SB 682 (Sen Lucido) with recommendation and immediate effect. 4. Testimony only SB 865 (Sen. Lucido). The Chair called the meeting to order at 8:33 a.m. He instructed the Clerk to call the roll. At that time, the following members were present: Chair Lucido, Sen (s). VanderWall, Barrett, Johnson, Runestad, Chang and Irwin, a quorum was present. The Chair entertained a motion by Sen. Barrett to adopt the meeting minutes from July 23, 2020. Without objection, the minutes were adopted. The Chair brought up SB 111 (S-1) and summarized the bill. The Chair entertained a motion by Sen. Barrett to adopt the (S-1) version of SB 111. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Johnston, Runestad, Chang and Irwin Nays: None The motion prevailed and the (S-1) was adopted. The Chair brought up SB 681 – 682 and invited Sen. Irwin to summarize the bills and amendments. Sen. Irwin withdrew amendment #1 to SB 681. The Chairman entertained a motion by Sen. Irwin to adopt amendment #2 to SB 681. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Johnston, Runestad, Chang and Irwin Nays: None The motion prevailed and the amendment was adopted. The Chair invited Sen. Barrett to summarize amendment #3 to SB 681. The Chairman entertained a motion by Sen. Barrett to adopt amendment #3 to SB 681. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Johnston, Runestad, Chang and Irwin Nays: None The motion prevailed and the amendment was adopted. The Chair entertained a motion by Sen. VanderWall to adopt the (S-1) version of SB 681. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Chang and Irwin Nays: Sen. Runestad Pass: Sen. Johnson The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. Irwin to report the SB 681 (S-1), as amended, as a clean substitute, to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Chang and Irwin Nays: Sen. Runestad Pass: Sen. Johnson The motion prevailed and the bill was reported. The Chair moved to recommend immediate effect for SB 681 (S-1). Without objection, immediate effect was recommended. The Chair invited the following individuals to present testimony regarding SB's 681 – 682: Sharon Denniston, Juvenile Advocate - Support The cards were read of those individuals not wishing to present testimony regarding SB's 681 – 682: John Cooper, Safe and Just Michigan – Support Noah Smith, Criminal Defense Attorneys of Michigan – Support Tom Hickson, Michigan Catholic Conference – Support Kevin McKinney, Michigan Cannabis Industry Association - Support The Chair entertained a motion by Sen. Barrett to report the SB 682 to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Lucido, Sen (s). VanderWall, Barrett, Chang and Irwin Nays: Sen. Runestad Pass: Sen. Johnson The motion prevailed and the bill was reported. The Chair moved to recommend immediate effect for SB 682. Without objection, immediate effect was recommended. The Chair summarized SB 865. The cards were read of those individuals not wishing to present testimony regarding SB 865: Peter Cunningham, State Bar of Michigan – Oppose Jess Averill Hammond, MI Domestic and Sexual Violence Prevention and Treatment Board There being no further business before the committee, the Chair moved to adjourn the committee.
