HOUSE OF REPRESENTATIVES COMMITTEE ON INSURANCE REP. MIKE HARRIS CHAIR COMMITTEE MEETING MINUTES Wednesday, December 17, 2025 Noon. Room 521, House Office Building The House Committee on Insurance was called to order by Chair Harris. The Chair requested attendance to be called: Present: Reps. Harris, Tisdel, Lightner, Posthumus, Aragona, Neyer, Schuette, Brenda Carter, Tate and Fitzgerald. Absent: Rep. Whitsett. Excused: Rep. Whitsett. Representative Aragona moved to adopt the meeting minutes from December 10, 2025. There being no objection, the motion prevailed with unanimous consent. The Chair laid HB 5298 and HB 5299 before the committee: HB 5298 (Rep. Harris) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 3114 (MCL 500.3114), as amended by 2019 PA 21. HB 5299 (Rep. Morgan) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 3107c (MCL 500.3107c), as added by 2019 PA 22. Representative Posthumus moved to adopt substitute (H-1) to HB 5298. The motion prevailed 10-0-0: FAVORABLE ROLL CALL Yeas: Reps. Harris, Tisdel, Lightner, Posthumus, Aragona, Neyer, Schuette, Brenda Carter, Tate and Fitzgerald. Nays: None. Pass: None. Representative Fitzgerald offered the following amendment to HB 5298: 1. Amend page 5, line 18, by striking out all of enacting section 1 and inserting: "Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 103rd Legislature are enacted into law: (a) House Bill No. 4576. (b) House Bill No. 5299.". Representative Fitzgerald explained the amendment. Representative Fitzgerald moved to adopt the amendment to HB 5298. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, Tate and Fitzgerald. Nays: Reps. Harris, Tisdel, Lightner, Posthumus, Aragona, Neyer and Schuette. Pass: None. Representative Tisdel moved to report out HB 5298 with recommendation, as substitute (H-1). The motion prevailed 7-0-3: FAVORABLE ROLL CALL Yeas: Reps. Young) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4731 (MCL 500.4731), as added by 2008 PA 29. HB 5383 (Rep. Neyer) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4705 (MCL 500.4705), as added by 2008 PA 29. HB 5384 (Rep. Brenda Carter) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4667 (MCL 500.4667), as added by 2008 PA 29. HB 5385 (Rep. Aragona) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4603 (MCL 500.4603), as added by 2008 PA 29. HB 5386 (Rep. Schuette) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending sections 4621 and 4625 (MCL 500.4621 and 500.4625), section 4621 as amended by 2018 PA 397 and section 4625 as added by 2008 PA 29. The following person submitted a card in opposition to HB 5298 and HB 5299, but did not wish to speak: Kevin A. McKinney, representing the Coalition Protecting Auto No-Fault. The following people submitted a card in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386, but did not wish to speak: Ken Ross, representing John Hancock. Ken Morin, representing the Life Insurance Association of Michigan. David Zyble, representing Jackson National Life. Jenny Geis, representing the Department of Insurance and Financial Services, testified in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386. Representative Tisdel testified in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386. Representative Brenda Carter testified in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386. Joseph Sullivan, representing the Michigan Department of Insurance and Financial Services, testified in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386. Gregory Nowakowski, representing Honigman, testified in support of HB 5380, HB 5381, HB 5382, HB 5383, HB 5384, HB 5385 and HB 5386. Questions and discussions followed. Representative Fitzgerald moved to excuse Representative Whitsett from the meeting. There being no objection the motion prevailed by unanimous consent.
