The agenda summary is as follows: 1. Reported SB 1138 (Sen. Schmidt), as amended, with recommendation and immediate effect. 2. Reported SB 1139 (S-1) (Sen. VanderWall) with recommendation and immediate effect. 3. Reported SB 1140 (S-1) (Sen. Moss) with recommendation and immediate effect. 4. Reported SB 934 (S-3) (Sen. Schmidt) with recommendation and immediate effect. 5. Testimony regarding HB 6190 (Rep. Webber). The Chair called the meeting to order at 9:38 a.m. He instructed the Clerk to call the roll. At that time, the following members were present: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki and Wojno, a quorum was present. The Chair entertained a motion by Sen. Zorn to adopt the meeting minutes from September 29, 2020. Without objection, the minutes were adopted. The Chair read the cards of those individuals not wishing to testify before the committee regarding SB 1138, SB 1139, SB 1140 and SB 934: Spencer Nevins, Michigan Beer and Wine Wholesalers Association – Support Scott Ellis and Mason Doerr, Michigan Licensed Beverage Association – Support Jon O Connor, Michigan Craft Distillers Association – Support The Chair invited the following individuals to present testimony regarding SB 1138, SB 1139 and SB 1140: David Marvin, Michigan Liquor Control Commission – Opposition The Chair invited the following individuals to present testimony regarding SB 1139 and SB 1140: Brendan Ringlever, Michigan Spirits Association – Support Page 1 of 3 At 9:40 a.m., the Chair recessed the committee. At 9:40 a.m., the Chair reconvened the committee. The Chair entertained a motion by Sen. Moss to adopt the (S-1) version of SB 1138. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. Lauwers to report SB 1138, as amended, to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 1138. Without objection, immediate effect was recommended. The Chair entertained a motion by Sen. VanderWall to adopt the (S-1) version of SB 1139. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. Moss to report the (S-1) version of SB 1139 to the floor with recommendation that it pass. The Chair made a motion to recommend immediate effect for SB 1139. Without objection, immediate effect was recommended. The Chair entertained a motion by Sen. VanderWall to adopt the (S-1) version of SB 1140. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the (S-1) was adopted. The Chair entertained a motion by Sen. VanderWall to report the (S-1) version of SB 1140 to the floor with recommendation that it pass. The Chair made a motion to recommend immediate effect for SB 1140. Without objection, immediate effect was recommended. Senator Theis offered an amendment to the (S-2) version of SB 934, identified as Amendment #1. Page 2 of 3 The Chair entertained a motion by Sen. Zorn to adopt Amendment #1 to the (S-2) version of SB 934. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the amendment was adopted. The Chair entertained a motion by Sen. Theis to adopt the (S-2) version of SB 934. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the (S-2) was adopted. The Chair entertained a motion by Sen. Theis to report the amended (S-2) version of SB 934, as a clean substitute, to the floor with recommendation that it pass. The vote was as follows: Yeas: Chair Nesbitt, Sen.(s) Theis, Johnson, Lauwers, VanderWall, Zorn, Moss, Polehanki, and Wojno. Nays: None The motion prevailed and the bill was reported. The Chair made a motion to recommend immediate effect for SB 934. Without objection, immediate effect was recommended. The Chair invited the following individuals to present testimony regarding HB 6190: Rep. Michael Webber – Support Brian Bayer and Matt Watson, Goldfish Swim School – Support The Chair read the cards of those individuals not wishing to testify before the committee regarding HB 6190: Travis Boeskool, EGLE – Neutral There being no further business before the committee, the Chair moved to adjourn the committee.
