MATT KOLESZAR CHAIR COMMITTEE MEETING MINUTES Tuesday, March 21, 2023 9:00 AM Room 521, House Office Building The House Committee on Education was called to order by Chair Koleszar. The Chair requested attendance be called: Present: Reps. Koleszar, Churches, Shannon, Weiss, Glanville, Conlin, Edwards, Wegela, Greene, Markkanen, Paquette, Wendzel, Johnsen. Absent: Rep. Stone. Excused: Rep. Stone. Representative Glanville moved to adopt the meeting minutes from March 14, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4157, HB 4166, HB 4288 and SB 63 before the committee: HB 4157 (Rep. Coleman) A bill to amend 1976 PA 451, entitled "The revised school code," (MCL 380.1 to 380.1852) by adding section 1138a. HB 4166 (Rep. Koleszar) A bill to amend 1976 PA 451, entitled "The revised school code," by amending sections 502, 503, 507, 522, 528, 552, 561, and 705 (MCL 380.502, 380.503, 380.507, 380.522, 380.528, 380.552, 380.561, and 380.705), sections 502, 503, 507, 522, 528, 552, and 561 as amended by 2018 PA 601 and section 705 as amended by 2018 PA 23; and to repeal acts and parts of acts. HB 4288 (Rep. Koleszar) A bill to amend 1947 PA 336, entitled "An act to prohibit strikes by certain public employees; to provide review from disciplinary action with respect thereto; to provide for the mediation of grievances and the holding of elections; to declare and protect the rights and privileges of public employees; to require certain provisions in collective bargaining agreements; to prescribe means of enforcement and penalties for the violation of the provisions of this act; and to make appropriations," by amending section 15 (MCL 423.215), as amended by 2014 PA 414. SB 63 (Sen. Polehanki) A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1212 (MCL 380.1212), as amended by 2016 PA 319. A substitute (H-1) for HB 4166 was adopted by the Committee at the March 14th, 2023 meeting. Representative Koleszar introduced HB 4288. Senator Polehanki introduced SB 63. Questions and discussion followed. Jennifer Smith representing the Michigan Association of School Boards testified in support of SB 63. Questions and discussion followed. Mac Dashney, representing the Michigan Association for Pupil Transpotration. The following people submitted a card in opposition to SB 63, but did not wish to speak: Mike VanBeek, representing the Mackinac Center for Public Policy. Nate Henschel, representing the Grand Rapids Chamber. Leah Robinson, representing the Michigan Chamber of Commerce. Alicia Urban, representing the Michigan Association of Public School Academies. The following people submitted a card in support of HB 4166, but did not wish to speak: Jerry Johnson, representing the Barry, Branch, Calhoun, Jackson, Lenawee and Monroe Intermediate School Districts. Jennifer Smith, representing the Michigan Association of School Boards. The following people submitted a card in opposition to HB 4166, but did not wish to speak: Nate Henschel, representing the Grand Rapids Chamber. Molly Macek, representing the Mackinac Center for Pubic Policy. Carol Weaver, representing the Detroit Public Schools Community District. Representative Johnsen offered the following amendment to HB 4166: 1. Amend page 55, following line 8, by inserting: "Enacting section 2. This amendatory act does not take effect unless House Bill No. 4043 of the 102nd Legislature is enacted into law.". Representative Johnsen moved to adopt the amendment to HB 4166. The motion did not prevail 5-8-0: UNFAVORABLE ROLL CALL Yeas: Reps. Greene, Markkanen, Paquette, Wendzel, Johnsen. Nays: Reps. Koleszar, Churches, Shannon, Weiss, Glanville, Conlin, Edwards, Wegela. Pass: None. Representative Wegela moved to report out HB 4166 with recommendation, as substitute (H- 1). The motion prevailed 8-5-0: FAVORABLE ROLL CALL Yeas: Reps. Koleszar, Churches, Shannon, Weiss, Glanville, Conlin, Edwards, Wegela. Nays: Reps. Greene, Markkanen, Paquette, Wendzel, Johnsen. Pass: None. Representative Edwards moved to report out HB 4288 with recommendation. The motion prevailed 8-5-0: FAVORABLE ROLL CALL Yeas: Reps. Koleszar, Churches, Shannon, Weiss, Glanville, Conlin, Edwards, Wegela. Nays: Reps. Greene, Markkanen, Paquette, Wendzel, Johnsen. Pass: None. Representative Weiss moved to report out HB 4157 with recommendation. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Koleszar, Churches, Shannon, Weiss, Glanville, Conlin, Edwards, Wegela, Greene, Markkanen, Paquette, Wendzel, Johnsen. Nays: None. Pass: None. Representative Churches moved to excuse Representative Stone from the meeting. There being no objection the motion prevailed by unanimous consent.
