- HOUSE OF REPRESENTATIVES COMMITTEE ON CRIMINAL JUSTICE REP. KARA HOPE CHAIR COMMITTEE MEETING MINUTES Tuesday, May 9, 2023 9:00 AM Room 519, House Office Building The House Committee on Criminal Justice was called to order by Chair Hope. The Chair requested attendance be called: Present: Reps. Hope, Andrews, Tyrone Carter, Breen, Young, Arbit, Dievendorf, Tsernoglou, Filler, Mueller, Bezotte, Harris, BeGole. Absent: None. Excused: None. Representative Tsernoglou moved to adopt the meeting minutes from April 11, 2023. There being no objection, the motion prevailed by unanimous consent. Chair Hope laid before the committee a presentation by the Michigan Association of Treatment Court Professionals (MATCP). Kate Hude, MATCP Executive Director, gave a presentation to the committee. The Chair laid HB 4438 and HB 4439 before the committee: HB 4438 (Rep. Breen) A bill to amend 1969 PA 312, entitled "An act to provide for compulsory arbitration of labor disputes in municipal police and fire departments; to define such public departments; to provide for the selection of members of arbitration panels; to prescribe the procedures and authority thereof; and to provide for the enforcement and review of awards thereof," by amending section 2 (MCL 423.232), as amended by 2011 PA 116. HB 4439 (Rep. Bezotte) A bill to amend 1969 PA 312, entitled "An act to provide for compulsory arbitration of labor disputes in municipal police and fire departments; to define such public departments; to provide for the selection of members of arbitration panels; to prescribe the procedures and authority thereof; and to provide for the enforcement and review of awards thereof," by amending sections 5 and 7a (MCL 423.235 and 423.237a), section 5 as amended by 2011 PA 116. Representative Breen and Representative Bezotte testified in support of HB 4438 and HB 4439. Questions and discussion followed. O'Neal) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending sections 16, 18, 200i, 204, 207, 209, 210, 211a, 316, 436, and 543f (MCL 750.16, 750.18, 750.200i, 750.204, 750.207, 750.209, 750.210, 750.211a, 750.316, 750.436, and 750.543f), sections 16, 18, 200i, 204, 207, 209, 210, 211a, 436, and 543f as amended by 2014 PA 23 and section 316 as amended by 2022 PA 149, and by adding section 506b. HB 4163 (Rep. Hope) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending sections 1 and 1b of chapter IX (MCL 769.1 and 769.1b), section 1 as amended by 1999 PA 87 and section 1b as amended by 1998 PA 520; and to repeal acts and parts of acts. HB 4164 (Rep. VanderWall) A bill to amend 1939 PA 288, entitled "Probate code of 1939," by amending section 18 of chapter XIIA (MCL 712A.18), as amended by 2022 PA 209. Representative Young, Representative O'Neal, Representative VanderWall, and Representative Wilson testified in support of HB 4160, HB 4161, HB 4162, HB 4163 and HB 4164. Karen Jackson and Crystal Grigonis representing the Co-victims testified in opposition to HB 4160, HB 4161, HB 4162, HB 4163 and HB 4164.
