JOHN FITZGERALD CHAIR COMMITTEE MEETING MINUTES Wednesday, June 14, 2023 12:00 PM Room 519, House Office Building The House Committee on Local Government and Municipal Finance was called to order by Chair Fitzgerald. The Chair requested attendance be called: Present: Reps. Fitzgerald, Byrnes, Shannon, Breen, Rogers, Hill, Hoskins, Paiz, Zorn, Paquette, BeGole, Prestin. Absent: Rep. Bezotte. Excused: Rep. Bezotte. Representative Breen moved to adopt the meeting minutes from June 7, 2023. There being no objection, the motion prevailed by unanimous consent. Representative Rogers moved to excuse Representative Bezotte from the meeting. There being no objection the motion prevailed by unanimous consent. The Chair laid HB 4382 and HB 4383 before the committee: HB 4382 (Rep. Morse) A bill to amend 1956 PA 40, entitled "The drain code of 1956," by amending sections 551, 552, 553, 555, 556, 557, and 558 (MCL 280.551, 280.552, 280.553, 280.555, 280.556, 280.557, and 280.558). HB 4383 (Rep. VanderWall) A bill to amend 1956 PA 40, entitled "The drain code of 1956," by amending sections 559, 560, 561, 562, 563, 564, 565, 569, 570, 571, 572, 573, 574, 576, 577, 578, 580, 581, 582, and 583 (MCL 280.559, 280.560, 280.561, 280.562, 280.563, 280.564, 280.565, 280.569, 280.570, 280.571, 280.572, 280.573, 280.574, 280.576, 280.577, 280.578, 280.580, 280.581, 280.582, and 280.583), section 569 as amended by 2016 PA 27, and by adding sections 561b, 561d, 564b, and 569b; and to repeal acts and parts of acts. Brad Ward, David Pierson, Michigan Realtors; Katie Gordon, Grand Rapids Chamber; Dawn Crandall, Home Builders Association of Michigan testified in opposition to HB 4382 and HB 4383. Questions and discussion followed. Elmeka Steele representing the Wayne County/Michigan Association of Drain Commissioners testified in support of HB 4382 and HB 4383. Matt Meersman representing the St. Joseph River Basin Commission testified in support of HB 4382 and HB 4383. Judy Allen representing the Michigan Townships Association testified with no position on HB 4382 and HB 4383. The following people submitted a card with a neutral position on HB 4382 and HB 4383, but did not wish to speak: Travis Boeskool, representing the Michigan Department of Environment, Great Lakes and Energy. The following people submitted a card in support of HB 4382 and HB 4383, but did not wish to speak: Ken Yonker, representing the Kent County Drain Commission. The Chair laid HB 4360 before the committee: HB 4360 (Rep. Brabec) A bill to amend 1988 PA 57, entitled "An act to provide for the incorporation by 2 or more municipalities of certain authorities for the purpose of providing emergency services to municipalities; to provide for the powers and duties of authorities and of certain state and local agencies and officers; to provide for certain condemnation proceedings; to provide for fees; to provide for the levy of property taxes for certain purposes; to authorize the issuance of bonds, notes, and other evidences of indebtedness; and to prescribe penalties and provide remedies," by amending section 2 (MCL 124.602). Representative Brabec, Jason Sperle, Saline Area Fire Department, Herasanna Richards Michigan Municipal League testified in support of HB 4360. Questions and discussion followed. Representative Brabec representing the City of Saline Mayor Brian Marl testified in support of HB 4360. There being no further business before the committee, Chair Fitzgerald adjourned the meeting at 1:11 PM.
