LAURIE POHUTSKY CHAIR COMMITTEE MEETING MINUTES Thursday, June 22, 2023 10:30 AM Room 327, House Office Building The House Committee on Natural Resources, Environment, Tourism and Outdoor Recreation was called to order by Chair Pohutsky. The Chair requested attendance be called: Present: Reps. Pohutsky, Hill, Shannon, McFall, Paiz, Martin, Prestin, Schriver. Absent: Rep. Arbit. Excused: Rep. Arbit. Representative Martin moved to adopt the meeting minutes from June 8, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 52 before the committee: SB 52 (Sen. Cherry) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 40118 (MCL 324.40118), as amended by 2022 PA 23. The following person submitted a card in support of SB 52, but did not wish to speak: Taylor Ridderbusch, representing the Michigan Department of Natural Resources. Representative Prestin offered the following amendments to SB 52: 1. Amend page 1, line 4, after "to" by striking out "(19)," and inserting "(20),". 2. Amend page 6, line 27, by striking out all of subdivision (d) and inserting: "(20) The commission shall not issue an order or interim order requiring a hunter to report the harvest of game or retain a harvest confirmation number for that game. An individual who violates a provision of this part or an order or interim order issued under this part regarding the reporting of a deer harvest or retention of a deer harvest confirmation number is not subject to a fine or imprisonment for that violation.". Representative Prestin moved to adopt the amendments to SB 52. The motion did not prevail 3-5-0: UNFAVORABLE ROLL CALL Yeas: Reps. Martin, Prestin, Schriver. Nays: Reps. Pohutsky, Hill, Shannon, McFall, Paiz. Pass: None. Representative McFall moved to report out SB 52 with recommendation. The motion prevailed 6-2-0: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, McFall, Paiz, Prestin. Nays: Reps. Martin, Schriver. Pass: None. The Chair laid SB 14 before the committee: SB 14 (Sen. McCann) A bill to amend 1969 PA 306, entitled "Administrative procedures act of 1969," by amending sections 32 and 45 (MCL 24.232 and 24.245), as amended by 2018 PA 602. Representative Prestin offered the following amendment to SB 14: 1. Amend page 3, following line 14, by inserting: "(8) An agency shall not adopt or promulgate a rule that is more stringent that an applicable federal standard if this state's unemployment rate is greater than the national average for any consecutive 3-month period in the preceding calendar year. This prohibition continues until this state's unemployment rate is less than the national average for 3 consecutive months.". Representative Prestin moved to adopt the amendment to SB 14. The motion did not prevail 2-6-0: UNFAVORABLE ROLL CALL Yeas: Reps. Martin, Prestin. Nays: Reps. Pohutsky, Hill, Shannon, McFall, Paiz, Schriver. Pass: None. Pohutsky, Hill, Shannon, McFall, Paiz, Schriver. Pass: None. Representative Paiz moved to report out SB 14 with recommendation. The motion prevailed 5-3-0: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, McFall, Paiz. Nays: Reps. Martin, Prestin, Schriver. Pass: None. The following person submitted a card in opposition to SB 14, but did not wish to speak: Jacob Manning, representing the Small Business Association of Michigan. The Chair laid HB 4596 before the committee: HB 4596 (Rep. Mentzer) A bill to prohibit the sale, offering for sale, and distribution for sale of certain disposable wipes without meeting certain label requirements; and to prohibit certain acts and provide civil sanctions. Representative Shannon moved to adopt substitute (H-4) to HB 4596. The motion prevailed 7-1-0: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, McFall, Paiz, Martin, Prestin. Nays: Rep. Schriver. Pass: None. Representative Hill moved to report out HB 4596 with recommendation, as substitute (H-4). The motion prevailed 5-1-2: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, McFall, Paiz. Nays: Rep. Schriver. Pass: Reps. Martin, Prestin. The following person submitted a card in support of HB 4596, but did not wish to speak: Nick Occhipinti, representing the Michigan League of Conservation Voters. The Chair laid presentations on the Little Traverse Bay Bands of Odawa Indians and the Keewenaw Bay Indian Community before the Committee. Dr. Nichole Keway Biber gave a presentation on the Little Traverse Bay Bands of Odawa Indians. Questions and discussion followed. Theresa Pitts gave a presentation on the Keewenaw Bay Indian Community. Questions and discussion followed. Doug Craven gave a presentation on the Keewenaw Bay Indian Community. Representative McFall moved to excuse Representative Arbit from the meeting. There being no objection the motion prevailed by unanimous consent. There being no further business before the committee, Chair Pohutsky adjourned the meeting at 11:17 AM.
