The Chair requested attendance be called: Present: Reps. Shannon, MacDonell, Coleman, Conlin, Farhat, Fitzgerald, Hoskins, Miller, Outman, Roth, Bruck, Kunse, St. Germaine. Absent: None. Excused: None. Representative Coleman moved to adopt the meeting minutes from September 19, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4723 before the committee: HB 4723 (Rep. Morgan) A bill to amend 1949 PA 300, entitled "Michigan vehicle code," (MCL 257.1 to 257.923) by adding section 803s. Representative Roth moved to report out HB 4723 with recommendation. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Shannon) A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to promote safe and efficient travel for motor vehicle drivers, bicyclists, pedestrians, and other legal users of roads, streets, and highways; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, local bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; to investigate and study the tolling of roads, streets, highways, or bridges; and to repeal acts and parts of acts," by amending sections 12 and 13b (MCL 247.662 and 247.663b), section 12 as amended by 2020 PA 152. Damoose) A bill to amend 1945 PA 327, entitled "Aeronautics code of the state of Michigan," by amending section 80f (MCL 259.80f), as added by 2001 PA 225. Senator Damoose testified in support of SB 22. Jim Linderman, Emmett County Prosecutor, testified in support of SB 22. Kevin Klein, representing the Michigan Association of Airport Executives and Cherry Capital Airport, testified in support of SB 22. Questions and discussion followed. The following people submitted a card in support of SB 22, but did not wish to speak: Rebecca Bechler, representing Gerald R. Ford Airport. Troy Hagon, representing the Michigan Department of Transportation. The Chair laid HB 4845 before the committee: HB 4845 (Rep. Bruck) A bill to amend 2001 PA 142, entitled "Michigan memorial highway act," (MCL 250.1001 to 250.2092) by adding section 103a. Representative Bruck, joined by Monroe Township Assistant Fire Chief Mike Broman, Former Fire Chief Larry Merkle, and Former Firefighter Brian Merkle, all testified in support of HB 4845. The following person submitted a card with a neutral position on HB 4845, but did not wish to speak: Troy Hagon, representing the Michigan Department of Transportation. At 10:55 AM, the Chair laid the committee at ease. At 10:56 AM, Majority Vice Chair MacDonell called the committee back to order. The Vice Chair laid HB 4940 and HB 4941 before the committee: HB 4940 (Rep. Shannon) A bill to amend 1909 PA 283, entitled "An act to revise, consolidate, and add to the laws relating to the establishment, opening, discontinuing, vacating, closing, altering, improvement, maintenance, and use of the public highways and private roads; the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; maintaining public access to waterways under certain conditions; setting and protecting shade trees, drainage, and cutting weeds and brush within this state; providing for the election or appointment and defining the powers, duties, and compensation of state, county, township, and district highway officials; and to prescribe penalties and provide remedies," by amending section 21 (MCL 224.21), as amended by 1996 PA 23. HB 4941 (Rep. Filler) A bill to amend 1964 PA 170, entitled "An act to make uniform the liability of municipal corporations, political subdivisions, and the state, its agencies and departments, officers, employees, and volunteers thereof, and members of certain boards, councils, and task forces when engaged in the exercise or discharge of a governmental function, for injuries to property and persons; to define and limit this liability; to define and limit the liability of the state when engaged in a proprietary function; to authorize the purchase of liability insurance to protect against loss arising out of this liability; to provide for defending certain claims made against public officers, employees, and volunteers and for paying damages sought or awarded against them; to provide for the legal defense of public officers, employees, and volunteers; to provide for reimbursement of public officers and employees for certain legal expenses; and to repeal acts and parts of acts," by amending section 2 (MCL 691.1402), as amended by 2012 PA 50. Representative Shannon and Representative Filler both testified in support of HB 4940 and HB 4941. Questions and discussion followed. At 11:01 AM, Majority Vice Chair MacDonell laid the committee at ease. At 11:02 AM, the Chair called the committee back to order.
