KELLY A BREEN CHAIR COMMITTEE MEETING MINUTES Wednesday, September 27, 2023 10:30 AM Room 521, House Office Building The House Committee on Judiciary was called to order by Chair Breen. The Chair requested attendance be called: Present: Reps. Breen, Edwards, Tyrone Carter, Hope, Arbit, Dievendorf, Hoskins, Tsernoglou, Fink, Wendzel, Wozniak, Outman, Johnsen. Absent: None. Excused: None. Representative Arbit joined the committee remotely. Representative Edwards moved to adopt the meeting minutes from September 13, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4909, HB 4910, HB 4911, HB 4912 and HB 5047 before the committee: HB 4909 (Rep. Breen) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending sections 5104, 5106, 5310, 5313, and 5409 (MCL 700.5104, 700.5106, 700.5310, 700.5313, and 700.5409), section 5106 as amended by 2017 PA 136, section 5310 as amended by 2000 PA 54, section 5313 as amended by 2012 PA 545, and section 5409 as amended by 2000 PA 463, and by adding section 5106a. HB 4910 (Rep. Tsernoglou) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending sections 5305, 5314, 5406, 5417, and 5418 (MCL 700.5305, 700.5314, 700.5406, 700.5417, and 700.5418), section 5305 as amended by 2017 PA 155, section 5314 as amended by 2018 PA 594, section 5406 as amended by 2000 PA 464, and sections 5417 and 5418 as amended by 2000 PA 312, and by adding section 5314a. HB 4911 (Rep. Filler) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending sections 5303, 5304, 5306, 5306a, 5312, and 5416 (MCL 700.5303, 700.5304, 700.5306, 700.5306a, 700.5312, and 700.5416), section 5303 as amended by 2017 PA 155, section 5306 as amended by 2019 PA 170, section 5306a as added by 2012 PA 173, and section 5312 as amended by 2000 PA 54. HB 4912 (Rep. Borton) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending sections 5414 and 5415 (MCL 700.5414 and 700.5415) and by adding section 5312a. HB 5047 (Rep. Coffia) A bill to amend 1998 PA 386, entitled "Estates and protected individuals code," by amending section 5106 (MCL 700.5106), as amended by 2017 PA 136, and by adding part 5A to article V. At 10:42 AM, the Chair laid the committee at ease. At 10:43 AM, Majority Vice Chair Edwards called the committee back to order. Chair Breen, Representative Tsernoglou, Representative Coffia, and Representative Filler testified in support of HB 4909, HB 4910, HB 4911, HB 4912 and HB 5047. Questions and discussion followed. Attorney General Dana Nessel and Scott Teter representing the Michigan Department of Attorney General testified in support of HB 4909, HB 4910, HB 4911, HB 4912 and HB 5047. Questions and discussion followed. At 11:03 AM, Majority Vice Chair Edwards laid the committee at ease. At 11:04 AM, the Chair called the committee back to order. Christopher Smith representing the Elder Abuse Task Force testified in support of HB 4909, HB 4910, HB 4911 and HB 4912. Michelle Roberts representing the Disability Rights Michigan testified in support of HB 4909, HB 4910, HB 4911 and HB 4912. The following people submitted a card in support of HB 4909, HB 4910, HB 4911, HB 4912 and HB 5047, but due to the time constraints were unable to speak: Allison Hirschel, representing the Michigan Elder Justice Initiative.
