BRENDA CARTER CHAIR COMMITTEE MEETING MINUTES Thursday, September 28, 2023 9:00 AM Room 521, House Office Building The House Committee on Insurance and Financial Services was called to order by Chair Brenda Carter. The Chair requested attendance be called: Present: Reps. Brenda Carter, McFall, Coleman, Stone, Breen, Rogers, Scott, Fitzgerald, Grant, Harris, Markkanen, Bezotte, Aragona, Bruck, Neyer, Smit. Absent: Rep. Young. Excused: Rep. Young. Representative Scott moved to adopt the meeting minutes from September 14, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 356, SB 357 and SB 358 before the committee: SB 356 (Sen. Hertel) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 2212a (MCL 500.2212a), as amended by 2016 PA 276. SB 357 (Sen. Cavanagh) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 2213b (MCL 500.2213b), as amended by 2016 PA 276, and by adding section 2213e. SB 358 (Sen. Klinefelt) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," (MCL 500.100 to 500.8302) by adding section 3406z. Representative Breen moved to report out SB 356 with recommendation. The motion did not prevail 8-0-7: UNFAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, McFall, Coleman, Stone, Breen, Rogers, Scott, Fitzgerald. Nays: None. Pass: Reps. Harris, Markkanen, Bezotte, Aragona, Bruck, Neyer, Smit. Representative Breen moved to report out SB 357 with recommendation. The motion did not prevail 8-0-7: UNFAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, McFall, Coleman, Stone, Breen, Rogers, Scott, Fitzgerald. Nays: None. Pass: Reps. Harris, Markkanen, Bezotte, Aragona, Bruck, Neyer, Smit. Representative Rogers offered the following amendments to SB 358: 1. Amend page 2, line 12, after "is" by striking out the balance of the subsection and inserting "the de minimis variation as described in 45 CFR 156.140.". 2. Amend page 3, line 21, after "2213b," by striking out "or to". 3. Amend page 3, line 22, after "147.140" by inserting a comma and "or a catastrophic plan as described in 45 CFR 156.155". Representative Rogers moved to adopt the amendments to SB 358. The motion prevailed 16- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, McFall, Coleman, Stone, Breen, Rogers, Scott, Fitzgerald, Grant, Harris, Markkanen, Bezotte, Aragona, Bruck, Neyer, Smit. Nays: None. Pass: None. Representative Rogers moved to report SB 358 as amended, as substitute (H-1). The motion prevailed 9-0-7: FAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, McFall, Coleman, Stone, Breen, Rogers, Scott, Fitzgerald, Grant. Nays: None. Pass: Reps. Harris, Markkanen, Bezotte, Aragona, Bruck, Neyer, Smit. The chair laid before the committee a presentation from the Department of Insurance and Financial Services. Joseph Sullivan, the Legislative Liaison Manager for the Department of Insurance and Financial Services, and Parker Fisher, the Insurance Legislative Liaison for the Department of Insurance and Financial Services gave a presentation. Questions and discussion followed. There being no further business before the committee, Representative Coleman moved to adjourn. Chair Brenda Carter adjourned the meeting at 10:02.
