KARA HOPE CHAIR COMMITTEE MEETING MINUTES Tuesday, October 3, 2023 9:24 AM Room 519, House Office Building The House Committee on Criminal Justice was called to order by Chair Hope. The Chair requested attendance be called: Present: Reps. Hope, Andrews, Tyrone Carter, Breen, Young, Arbit, Dievendorf, Tsernoglou, Filler, Mueller, BeGole. Absent: Reps. Bezotte, Harris. Excused: Reps. Bezotte, Harris. Representative Young joined the committee remotely. Representative Arbit moved to adopt the meeting minutes from September 26, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4850 before the committee: HB 4850 (Rep. Glanville) A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961," by amending section 1307a (MCL 600.1307a), as amended by 2020 PA 307. Representative Glanville testified in support of HB 4850. Questions and discussion followed. The following people submitted a card in support of HB 4850, but did not wish to speak: Nathan Triplett, representing the State Bar of Michigan. The Chair laid HB 4948 and HB 4960 before the committee: HB 4948 (Rep. Grant) A bill to amend 1972 PA 348, entitled "An act to regulate relationships between landlords and tenants relative to rental agreements for rental units; to regulate the payment, repayment, use and investment of security deposits; to provide for commencement and termination inventories of rental units; to provide for termination arrangements relative to rental units; to provide for legal remedies; and to provide penalties," (MCL 554.601 to 554.616) by amending the title and by adding section 2a. O'Neal) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16m of chapter XVII (MCL 777.16m), as amended by 2023 PA 22. HB 4946 (Rep. O'Neal) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 224f (MCL 750.224f), as amended by 2014 PA 4. The following people submitted a card in support of HB 4945 and HB 4946, but did not wish to speak: Mary Pollock, representing the American Association of University Women of Michigan. Rachel Richards, representing the Michigan League for Public Policy. Aaron Van Langevelde, representing the Michigan Department of Attorney General. Amend page 3, line 16, after the first "of" by striking out "8" and inserting "3". Representative Filler moved to adopt the amendment to HB 4946. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Filler, Mueller, BeGole. Nays: Reps. Hope, Andrews, Tyrone Carter, Breen, Arbit, Dievendorf, Tsernoglou. Pass: None. Representative Filler offered the following amendment to HB 4946: 1. Amend page 5, line 12, after "person" by inserting "within the previous 10 years". 2. Amend page 5, line 15, after the first "resident" by inserting "of the convicted person's household,". 3. Amend page 5, line 16, after "household" by inserting "within the previous 10 years". Representative Filler moved to adopt the amendment to HB 4946. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Filler, Mueller, BeGole. Nays: Reps. Hope, Andrews, Tyrone Carter, Breen, Arbit, Dievendorf, Tsernoglou. Pass: None. Representative Andrews offered the following amendment to HB 4946: 1. Amend page 3, line 22, after "probation" by striking out "or parole". Representative Andrews moved to adopt the amendment to HB 4946. The motion prevailed 10-0-0: FAVORABLE ROLL CALL Yeas: Reps. Representative Tyrone Carter moved to report House Bill No. 4946 as amended, as substitute (H-1). The motion prevailed 7-1-2: FAVORABLE ROLL CALL Yeas: Reps. Hope, Andrews, Tyrone Carter, Breen, Arbit, Dievendorf, Tsernoglou. Nays: Rep. Mueller. Pass: Reps. Filler, BeGole. The Chair laid HB 4718 before the committee: HB 4718 (Rep. Pohutsky) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," (MCL 760.1 to 777.69) by adding section 21d to chapter VIII. The following people submitted a card in support of HB 4718, but did not wish to speak: Mary Pollock, representing the American Association of University Women of Michigan.
